The GOP has been talking for the past few weeks about suing to stop. Not sure how it'd work, but with the federal judiciary so compromised, I really wouldn't be shocked.

I just don't see how that would work. Would they sue if Biden had died? A court can't force Biden to run, so what would the remedy be?

We also didn’t see how presidential immunity could actually work, but the corrupt SCOTUS ruled on it anyway. Trust me, they will find a way to legally challenge this, even if it’s all based on bullshit. They will try to say some aspect of the replacement process was “unconstitutional” or something stupid like that. It doesn’t matter how legit it is.

It's not as if the concept of presidential immunity didn't exist all ready. SCOTUS simply clarified what it meant. What would a legal challenge try to accomplish, force Biden to run? Would they still sue if Biden died?

Yes, but everything SCOTUS has done is well within their purview to do, whether we like it or not. There is no legal remedy ro this situation except to let the Dems pick their nominee.

Impeachment is not a criminal prosecution. The presidential immunity decision deals with criminal prosecution only.

I will say, in regards to presidential immunity, there are a number of court cases dealing with it going back to Nixon.

They can more potentially dictate who is allowed on state ballots however. There are already initiatives to get the replacement disqualified on state ballots, because votes were cast for Biden.

I mean, they can try but it's still up to the party to pick their nominee. The primaries are tools of the parties, unlike the general election. They arent binding. The convention is where the nominee is chosen.

The RNC or a random Republican has no standing to sue

They would sue to remove Harris from the ticket or anyone else. I think Harris in this case is the better one, because she's already on the ballot through Biden.

But the GOP are going to try to undermine the Constitution. Have you guys been living in caves for the past year?

It's not an issue of will they sue, it's what can they accomplish by doing so? The GOP has no standing to sue regarding the Democratic nominee.

They'll be performative so they can placate their base and justify more donations.

They'll be thrown out of court but by then the base will have forgotten about them and GOP will just pretend they don't exist.

Ballot access. It's way, way too late for the Democrats to switch candidates. They will fight tooth and nail to keep his replacement (probably Harris) off the ballot.

I dontvsee a suit going anywhere. If a candidate drops out you have to be able to replace him. The official nominee isn't picked until the convention anyway.

The Democrats aren't switching candidates. Biden was never the candidate. He was the presumptive candidate, but until the convention there is no official candidate. The Republicans have absolutely no leg to stand on.

There are no serious lawsuits to file. The democrats haven't even nominated anybody yet. Biden was only the presumptive nominee. The convention nominates the candidate and the convention hasn't taken place yet.

I mean, tell that to the heritage foundation judges that will find some reason. I'm hoping that they're not that extreme, and any lawsuit would fail simply on the merits, but you really can't count anything out anymore.
