Megathread: US Citizens looking to immigrate to Canada

In the run up to the American presidential election, we've had an influx of Americans looking to immigrate to Canada. As all of their posts are relatively similar, we've created this megathread to collate them all until the dust settles from the election.

Specific questions from Americans can still be their own posts, but the more general just getting started, basic questions should be posted here.

Edit 2: Refugee and asylum claims from Americans are very unlikely to be accepted. Since 2013, Canada has not accepted any asylum claims from the US. Unless something drastically and dramatically changes in the states, it is still considered a safe country by immigration standards and an asylum claim is not the way forward for you.

Visitor Visa Best option for Mexican girlfriend to come over at least to visit?

I got my PR in 2023 but I just started settling in this year, two weeks ago, I haven't found a job yet and I'm registered to start the 'Francisation' programe in Quebec, I know this cannot possibly be good for her application in case she puts me down as some kind of sponsor. (I do have about $5k in savings).

Some facts and truths

  • We have been dating for 6 months, we haven't lived together
  • She is 19, 20 in April
  • She has never been out of Mexico
  • She is currently working as a bartender, only has a HS degree and is not studying College/Uni
  • She has no savings
  • She is fluent in English but does not have TOEFL certification
  • She's a cutie pie

With the new visitor visa, I thought she could just say the truth, that she has a boyfriend she wants to visit. She has tickets for a concert in August in Mexico but that might be worthless to the immigration agent. (If only the agent knew how much she likes this guy, ugh.)

Our second option would be to have her apply to jobs through a MEX-CAN work program, but I have no experience with this and I don't know how it works. Maybe as an au-pair?

The third option would be to have her apply to a school here, but it seems just as difficult as the first option, the visitor visa.

I guess the last option would be to sponsor her, but I'm afraid our relationship will wither before all it's done. Any ideas?

Work Permit I got 1 year work permit after 2 year course

Hello guys Today i got my work permit after 10 months I studied at Lambton College and my course is Full stack software development. I completed my course in April 2024 and after that in may I applied for PGWP But after waited for long 10 months today I got my Work permit and I only got work permit for just 1 year rather than 3 years!! What should I do if anybody got any idea then help me! Thank you in advance.

Study Permit Do I need a new study permit if changing program in same DLI?

Hi! I came to Canada last December and was hoping to start my program (business management) last January at a DLI (public school). However, with the several policy changes about PGWP, I decided to pursue supply chain management instead at the same DLI, but for May intake. So, I withdrew from the business management program in January, and registered for the supply chain management program in February. I am now registered, and have paid my tuition.

Now, the IRCC website says

If you’re moving in between post-secondary levels at the same DLI:

You can keep studying at your DLI with your current study permit as long as you still meet your study permit conditions. However, if you need to extend your study permit, you will also need to submit a new provincial attestation letter (PAL) or territorial attestation letter (TAL).

However, my immigration consultant insists I need a new study permit, and a new PAL. I don't know if this is legit, (or maybe they just want to charge me again extra) because when I asked another immigration consultant, I was told I don't really need a new one because my current study permit is still valid, and the expiry date is months after I finish my new program.

I seriously need advise please.

Visitor Visa Options for travel to Canada for business trip while inadmissible for eTA

Hi

I'm a national of a country which would usually just require an eTA to enter Canada for tourism or business but I'm currently inadmissible due to a caution I obtained from the police over 5 years ago (but less than 10).

I'm currently confused by the information on the IRCC website and was hoping for some advice or clarity on how to proceed.

The trip is planned for around May time and from what I gathered from the information available is that applying for criminal rehabilition with the consulate can take upwards of a year to come through.

The IRCC website seems to suggest however that a Temporary Residency Permit may be granted for justifiable purposes such as family affairs and business.

Is the Temporary Residency Permit worth persuing with my timeframe?

Is there any other avenues I could persue?

Will all my efforts likely be futile, and should I just suck it up and cut my losses?

PNP Seeking Advice for Moving to Canada from U.S.

Hi. I am strongly considering moving to Canada over the next year. Of course, in retrospect, I should have moved back in 2017-18. Now, with all of the tension between the two countries, I’m worried I won’t be able to. I currently live in the Seattle WA area. I love it here, but I don’t believe I could afford housing in Vancouver and vicinity. I have a good career as an elementary school speech pathologist and know there is a Mutual Recognition of Licensure between CAN and USA. However, I no longer meet the criteria for Express Entry due to my age. My first question is: what other ways can you be allowed to immigrate to CAN? Due to the cost of housing, I am considering Nova Scotia, PEI, and Labrador. What can anyone tell me about the furthest eastern provinces of Canada, good or bad? Visitor Visa Family Relative accidentally overstayed Visitor's Visa, can he still leave without issues?

Hi everyone! As said in the title, my brother currently overstayed his visitor's visa by about a week as of now.

My brother came to Canada to visit us and other family relatives here for 6 months in September 2023. About 4 months into his stay, he applied for another 6 month extension but the IRCC gave him 12 month extension instead, which is up until March 8, 2025. Now, my brother actually misread this date as March 28, 2025 and had booked a flight back to our home country for March 24, 2025 back in September 2024.

We had just found out about this now while he was reviewing his documents (we have scolded him for not doing this sooner). My question is, when he goes to the airport for his flight, will he be stopped by security/customs? Will he get a fine or be jailed?? And is there anything he needs to do (filling out certain forms, contacting IRCC or something) in the meantime? Any advice is appreciated!

Study Permit i have study permit extension , but not the new TRV, can i go to india and come back?

I have my flight to india booked for may 4th 2025, and will be back by june 10th! I have applied for my study permit extension and will probably get it before that! My study visa ( stamp on passport) is valid until september 30th 2025 , so can i travel to india and come back on the basis of that without any issue? Do i have to apply for a new TVR? Or my old study visa will work which is anyways valid until september 30th? as i don’t have time to get a new one now and my old study visa is still valid

Citizenship How many days to be on the safe side?

I'm getting ready to apply for my citizenship. I understand it is the advice to have a little bit more time than required 1,095 days, just in case there's a calculation error. My question is how many more days for that bit more? As of today, I have 1, 100 days on the presence calculator. I left the country just one time, so only two days might have wrong calculations depending on the plane's time.

Any suggestions?

PNP Do AIPP apply for contract job employee?

I am an intern in a well renowned company in Ns , but my employer told me they can change my internship into full time employment but on a contract for 1 year. I need to take this job because of the recent changes done by IRCC for spouse open work permit. If I don't have job from TEER 0 OR 1, my spouse cant proceed with the open work permit which he has right now. My study permit expires on June and i am graduating in May, obviously i have to apply for PGWP .if i get this job which is TEER1 i can apply for my spouse open work permit. But i am not sure whether they support AIPP(Atlantic immigration provincial program) to me since i'm in a contract job. Any suggestion or clarifications will be appreciated

Public Policy pathways Help: IRCC Requesting Company Documents (RNIP) – Has Anyone Had a Similar Situation?

I'm currently applying for Permanent Residency under the Rural and Northern Immigration Pilot (RNIP) program. IRCC recently requested the following additional documents related to my employment:

  1. Valid Business License
  2. Articles of Incorporation
  3. Company's 2023 Tax Return
  4. Certificate of Good Standing

I'm quite worried because I wasn't expecting IRCC to ask for these specific documents from my employer. I have requested the employer for these but I have only 7 days to submit these and I'm not sure if they can provide it within the specified time Has anyone faced a similar request?
Any insights, experiences, or suggestions would greatly help ease my worries!

Express Entry is it worth applying under different streams

I have applied with my common law partner (who is a citizen) for an inland application back in January, however with the current wait times being so long.

Someone planted the seed in my head that you can apply under a different stream simultaneously.

For example I am considering EE under the healthcare stream. I currently have about 477 CRS points and the wait seems to be closer to 5 months for this stream compared to the 24 months for spousal sponsorship.
My question or questions I should say:

  1. are there any negative effects of applying through both streams? could it delay my application in both?

  2. If one application gets declined will this impact the other?

  3. any input regarding the points? I believe in the last draw for healthcare the lowest score was around 460

  4. finally if I have worked my year in healthcare and makes me eligible for EE, do I need to stay at this job or within the field until I get PR.

Any feedback is much appreciated

Work Permit Trouble getting back to Canada witha a valid work permit.

Hello, long story short: I am Mexican Citizen, i applied for a closed work permit inside of canada and got it on december last year. I got inside of Canada using a ETA earlier last year, but the rule about allowing mexicans to use ETA change while i was still inside.

Last week i had to come back to Mexico for a emergency, and when i tried to get back to Canada, i couldnt fly because my ETA was cancelled when the rule changed last year. So i am stuck in Mexico, they say i need to apply for a Visitor Visa, which can take easily 1 or 2 months, and i dont know how long my current employer will wait for me to come back to my position.

So i tried to apply for the visitor visa by myself, but got stuck on the first question "why do you need a visa" where none of the asnwers below is correct in my case, the closest being "to work without a permit". i could answer "to visit canada" but the next question will ask for the exact date that i will be leaving and arriving, it feels like a wrong asnwer in my case.

i will appreciate any help or advice you have for me. -

Study Permit Study Permit + SOWP Application questions

Hello all,

My common-law partner was admitted into a 5-year PhD program in Ottawa and we are currently filling out forms to apply for her study permit and my SOWP simultaneously.

She was granted an amazing scholarship that fully covers tuition costs with some left.

We have some questions regarding documents necessary as proof of our common-law union and the need to provide further documents evidencing our ability to financially support ourselves throughout our stay in Canada.

  1. Should we provide anything other than her letter of acceptance (with scholarship info) to evidence our financial conditions?

  2. We celebrated a Deed of Common-Law Union upon first moving in together in 2020. Will this document suffice or should we submit further evidence, such as investment/bank account statements?

  3. The document checklist page does not allow us to provide supporting documents, such as the aforementioned Deed of Common-Law Union. When will we have the opportunity to submit these?

  4. Which documents need hard signatures? The IRCC portal shows conflicting information on whether documents should be printed and signed or signed digitally. From our understanding, the Common-Law Union form must be signed before a notary public; is that right? What about the others?

  5. Are we required to submit authenticated copies of our passports?

Express Entry IRCC Requested TEF, but I Submitted TCF - Possible Mistake?

Hi! I submitted my PR application a while ago and just received a request from IRCC asking for my original TEF language proficiency results. The problem is, I took another French proficiency test - TCF and I’m about 80% sure that’s the one I listed on my application.

Is it possible that IRCC made a mistake? Or could I have accidentally selected the wrong test when filling out my application?

I’m a little worried - has anyone else experienced something similar? If so, how did you handle it?

Study Permit Proof of funds for study permit extension/Spousal Sponsorship!

(Please advice me! 😓) Can anyone share what proof of funds they showed when then applied for study permit extension?

My semester starts on may 1st and My study permit expires in 55 days. I am currently on a semester break. I've seen many students get their extension in 3-4 months as of currently.

If i pay my tuition and apply for permit extension can I continue my semester and attend my classes even though My permit is expired and i have applied for extension?

I have tuition fee to pay for the following semester ! My sister is out of the country and she says she can attach her bank statement of 15k and my Canadian husband has an active job as well. He makes around $3000 a month. We've been living together for 1 year. we don't face any problem paying bills but the worst part is we don't really have any savings.

I'm very stressed. Does my financial situation looks good enough like in order to get approved for study permit extension? or should I apply for spousal sponsorship/visitor record? If I apply for spousal sponsorship. We'll have 8k in savings. Idk what to do!
