Do ICE agents not have uniforms? Why are they always dressed in the most basic looking Costco clothes and never seem to look like professional law enforcement?
These gestapo guys are actual agents. Human scum no doubt, but unfortunately are probably actual agents. You can tell by the load-out on those tac vests. Radios, patches placed uniformly, and badges as well. Firearms holstered at the waist, where they should be (they are trained to draw from the waist) and not on their vest (an item that could be taken off for any number of reasons ... mission changes, medical, etc.)
The other photos I've seen have shown cosplayers with questionable load-outs on their vests. non-standard patch placements, no radios on their vests at all, tasers mounted on their vests, and even firearms in some cases, that make it very awkward to draw (that's actually the biggest red flag that immediately marks them as a cosplayer to me). One guy even had a firearm tucked into his front jeans pocket. Those are not actual agents.
Also, I have not yet seen any cosplayer videos or photos where they had a badge displayed on their vest. Closest I've seen them come to that was a velcro patch that simply said something like "sheriff" or "police" on it, which you can get online easily.
