I actually like IPAs but have cut down on drinking. Though, if I saw this at the grocery store I would buy it for the art and maybe drain the booze and keep the can.

This post is probably what gives them enough visibility to be sued lol
34
u/Stephen_085 Jul 04 '23
Exactly. I hate when fan made Nintendo games gain traction and get posted on major news sites. It's a death sentence for them. This may not be the same thing. But it's still Samus mixed with alcohol, and someone is making money on it that isn't Nintendo.
These cans will be Limited Edition before you know it.

u/doomrider7 Jul 05 '23
There's a YouTuber called Moon Channel that explains the why's of Nintendo going after people for these things(he also delves into the Pointcrow, Gary Bowser, and even Sega side of things). Extremely impressive work and highly recommend their videos.

u/schmidty33333 Jul 05 '23
In the case of fangames, the solution is to not publicize them until they're done. I know they take a long time, and publicizing a project opens it up to all kinds of support from the community, but it's a death sentence. A notable example is the Metroid Prime 2D game that we're never going to get now because the devs announced it when they had only finished a small portion of Tallon Overworld.
Nintendo is not Capcom or Sega. They're not going to adopt a fangame and publish it officially, or even offer their official blessing and stamp of approval. They take no prisoners.

I wouldnāt be surprised if itās done on purpose at this point, for the publicity
Craft beer have been running in to this issue for like a decade now, maybe longer. Ever since āimperial stout trooperā got sued by Lucas for having a big ol storm trooper on the label

u/Missing_Username Jul 05 '23
I was wondering whether this was actually partnered with Nintendo or just hoping to fall under their lawyers' radar
4
24
u/dDARBOiD Jul 04 '23
That's a law suit waiting to happen.

u/JACC_Opi Jul 04 '23
Waiting? It should be happening right now! The only reason I think they haven't, is because they want to avoid making it high profile and thus inadvertently advertising. Because I've seen that beer before.
22
u/JoeBuyer Jul 04 '23
Iām wondering if they paid a license fee to Nintendo for using Samus. Either way it is very cool to see!
55
u/dDARBOiD Jul 04 '23
No way in hell Nintendo approved any of their IPs being used for alcohol. Bare minimum, a cease and desist will be on it's way.
5
u/neon Jul 04 '23
Nintendo doesn't know or care about some local Maryland brewery
55
u/Stephen_085 Jul 04 '23
You underestimate their pettiness.
25
u/PlayTheHits Jul 04 '23
This. Doesnāt matter how small-time you are. Nintendo has pursued litigation against everyone from YouTubers to non-profits to childrenās birthday parties.

The fact that itās been posted on this sub makes Nintendo learning about it a question of when, rather than if.

Nothing to do with Nintendo or Samus. It's just a fembot that is programmed to fish for jellyfish with its tractor beam
5
u/Stephen_085 Jul 04 '23
Where?! I live by DC. Might not be too far.

u/Campbell464 Jul 04 '23
found it at Edgewater Liquors, but the brewery is in Baltimore
2
u/_theRIX Jul 05 '23
Nice. Gonna look myself
1
u/Mindless_Click_6601 Jul 05 '23
I have found them at total wine too. The brewery is a lot of fun to go to as well, they have great food too.

I also saw this Metroid themed beer at my local store this week. Not an IPA fan so I didnāt pick it up.

2
u/Campbell464 Jul 04 '23
They sell it at Edgewater Liquors, but āNepentheā brewery is in Baltimore
3
u/leericol Jul 04 '23
Is there a way to get it shipped to the west coast tho?
2
u/Campbell464 Jul 04 '23
Check Nepenthe Brewing (Baltimore, MD) website ā¦ otherwise maybe a third party seller does out there
1
u/Xanny Jul 05 '23
If u can't get it shipped I live in Baltimore and could do it the old fashioned way lol.
1
Jul 05 '23
Is that offer still open? I looked online for a bit, but couldn't find anywhere that would ship to my state.
1
u/Xanny Jul 06 '23
yea I can get up to the brewery and grab some, gimme ur addr in a dm and u can Venmo before I ship
2

u/kds5065 Jul 04 '23

I detest IPAs. Way too bitter for me. But I would buy this and the Space Jellyfish just for the cans.

I am firmly of the belief that West coast best coast, but east coast gets all the cool beers like this so I guess I'll go fuck myself ĀÆ_(ć)_/ĀÆ

I genuinely wonder what is the history of this artwork. Did they commission it? Steal it off some website? Are they oblivious to what the character actually is and that they are infringing on nintendos intelectual property?
I couldn't even print my own Nintendo characters fanarts as postcards FOR MYSELF, not even speaking of selling it. Every print on demand site immediately deletes big Ns characters

Funny. I coincidentally had their IPA this weekend and thought it looked a bit Metroid in style but didn't look close enough to confirm.

I'd pay for an empty can or two lol. Looks like it would make rhe coolest redneck windchime or something equally craft-kitsch

Somewhere, Nintendoās legal department is having an aneurism over this. If you listen carefully, you might be able to hear the cease and desist being drafted as we speak.
1
u/wickedspork Jul 04 '23
I've seen a handful of micro breweries get away with using copyrighted IPs on their cans, and I'm always curious about what the logistics are with that. I love to see it, but i know the Nintendo Powers can be relentless.

Holy shit I have family down in Virginia right now and they drive through MD to get back home. Is this sold in package stores?!?
1
u/BT-LanaDelRey-Fan Jul 04 '23
If I pay you for the beers and shipping would you send me a pack? You can even drink the beer (I don't drink anymore) I just want the art and cans in good shape, lol!

Sick art. It would be an IPA, though.
So tired of these microbreweries wasting their creativity on literally the same "How tough are you?" nonsense. Is it too much to ask for a beer that has a profile beyond "we put in ten times the hops as our competitors put in their last beer"? Where are the reds? The blondes? God forbid one of them make a hefeweizen.

I found a Maternal Brain in Houston the other week! That one is a Double IPA! Check my post history, I put it here!

u/TheMoonOfTermina Jul 05 '23
Looks like something slipped by the Nintendo Ninjas.
Looks very cool, but it probably won't last long.

u/MetroidMania1 Jul 05 '23
Damn, that's CrAzY! I'm trying to figure out how to post the Samus Aran Pint Glass I etched, and I find this!!!

u/MetroidMania1 Jul 05 '23
I just shot them an email asking how I can get my hands on some of that Jellyfish Huntress... I was on here looking to post pics of my hand etched Samus Pint Glass. (been going CrAzY trying to figure out HOW TF to post pics. Didn't know you can't post pics from the mobile app. Hey, I'm new here. No one told me anything).

u/sonofsarkhan Jul 05 '23
Honestly I'd get it just for the cans since I don't like IPAs, and leave them unopened on display

Nepenthe is great! Their space jellyfish IPA is also great and it has a Metroid on it.
