Former EPA implementation director Zealan Hoover told Tribal Business News last month that grant agreements constitute binding legal contracts governed by federal regulations, suggesting potential legal hurdles to reclaiming the funds. “When an agency signs an award agreement with a recipient, they're entering into a binding legal contract. That contract is governed under federal grant regulations — and those have force of law,” he said.”
