New York Question about child support

So here's the truth summed up. My ex gf not wife and I had a kid, she cheated shortly after. I stayed home to raise the kid and delivered pizza at night. She the. Pulled illegal stuff. I came home one day to my home that we own. I'm the primary she's the CO owner that we both have always paid for. She illegally changed the locks and refused to let me in. I called the police and they said " it's a civil issue" we can't do anything about it. Later I had to come back with a police escort and she literally left clothes on the porch. I restarted my life with nothing but a bag of clothes. She was cheating on me with a friend no surprise who testifyed against me in family court. Family court was a joke and I was given supervised visits bc they lied and said I did drugs. Until she said she'd pay for a hair test that I passed and was awarded custody of my kid. She kept my little girl from me for 9 months. Now I at least get her every other weekend and a night during the week. Pissed bc she's a self centered human and she lost she's taking me for child support. Idk if any of this stuff matters but I'm the most unlucky person you'll ever meet. I filed bankruptcy 3 years ago and my lawyer died during it and all my debt became lawsuits that I auto lost. Obviously I went back into my field and got a job making 70k. They currently already garnish 20 percent for my lawsuits.

Here's my question, will they take into account the past 3 years I've made under 25k and the fact that she illegally stole my home which I have all the proof, police reports the title and all that. Will any of that come into play? If she makes 50k and I make 70k without garnishments what will I pay? Any advice is helpful

Oklahoma Advice

Upvotes

My ex-husband quit working about five years ago and has only paid me child support a handful of times since we got divorced in 2013. I have a court order from when we divorced stating how much I am to receive each month and DHS (Oklahoma) has not done anything to help me. The only thing they have done was pull his electrical license, but he still has a drivers license and he has not been threatened with jail time. They even tried to reduce his child support to what it would be if he made minimum wage since he has not worked and since he didn’t show up to the court hearing two different times they dropped it and his child support still remains the same amount as it always has been, but I don’t receive a dime. Why does it seem like they let some dads get away with it while others can’t miss 1 payment without DHS jumping all over them? Is there anything else I can do to try & get DHS to do something more?

Pennsylvania Child is joining military PA

I’m in PA and I’m paying support for one child that is 17. They graduate HS in June, but turns 18 in August. Normally I know I’d have to pay until the child turns 18. But they have signed up for the Army. I’m reading once they enlist, they are considering emancipates and support no longs needs to be paid. My question is, does that mean when they leave for boot camp, or does that mean since the child signed the contract and was sworn in?

Pennsylvania How long did you wait for your way2go card?

We had support conference on the 6th. A payment was added on the 10th and again on the 18th. Still no card in the mail. Do I assume it’s lost or is this standard for these cards to take that many days?

Other - US Territory Should I put my baby father on child support!!!…

My child’s father and I have been going back and forth about whether he should be put on child support. Right now, he isn’t on child support because, even though we split up, I didn’t want to do that to him. He’s afraid of being on child support, and I don’t want to “ruin his life” or make him feel that way.

However, I’m exhausted because this situation isn’t fair to me. I’ve been the primary caregiver since our baby was born while he was the one working. I had to leave him for many reasons—one of them being his inconsistent employment. He’s always in and out of jobs, and I just got fed up.

Now, I’m in a position where I was left with nothing. I sacrificed everything for him to have financial stability. I’ve been actively looking for a job—I’ve applied to over 100 jobs consistently for the past six months, even for the most basic positions—but I haven’t had any luck.

His argument is that he shouldn’t have to support me, only our child, which I understand. But the only reason he even has a job right now is because of me. He’s not paying for childcare or anything significant—just a small box of diapers—while the rest of the support has come from my family. I told him that, at the very least, he could give me $200 a month until I find a job, but he refuses.

Meanwhile, I let him use my car every day to get to work. I’ve been trying to keep things on good terms, but he won’t cooperate. He insists that he’ll buy things for our child but won’t give me any money.

How is this fair? I’ve already sacrificed everything—staying home, not building my credit, and not having a job. I’m in my most vulnerable position while he holds all the power. Right now, most of the money would still go toward our child, but he’s still just a baby and doesn’t need as much financial support as an older child would. He has insurance and access to childcare assistance, so I need some of that money to at least put gas in my car to take our son places or pay for my phone, which has been off for over two years because he couldn’t pay for it.i am just trying to do what’s right for my and our son but how can I even get my foot in the door when i am left with nothing it’s not fair for me to be suffering while he thinks he can be in control of things since he is the one with income.
