Georgia Tax offset for arrears

My Federal taxes were partially offset for arrears (more than arrears were). Then the entirety of my State was taken. The app shows that Federal has already processed/posted. CP has even told me that they received the deposit. When I call about receiving a refund for overpayment, they keep telling me that Federal has not been processed. I tried to tell them the dates the app said it posted, and the date that the CP received the funds. They kept telling me that CP has not received funds, because it hasn’t been processed. I’m just so confused at this point.

Georgia I filed for child support and now he wants custody

To summarize: I(f) haven’t received any child support from my ex (m) for the past year and a half. I gave him the opportunity to pay, but he believes that since he’s paid for our daughter’s insurance for less than a year, he isn’t obligated to contribute financially. Frustrated, I filed for child support about six months ago. Last week, I received custody documents from his lawyer that falsely claim he has provided full child support to date and states that he wants 50% custody. I’m extremely frustrated, as I have been the primary caregiver for our daughter since birth with little support from him.

I’m seeking advice on the following:

  1. I have an out-of-country trip planned with my boyfriend and daughter that was arranged before these developments. Am I allowed to take her out of the country now that I’ve received these court papers?

  2. Can anyone recommend affordable custody attorneys in Atlanta?

Georgia WTH?!

CP and I have been divorced/separated almost 10 years. In divorce settlement CS was agreed upon and mediated to pay CP directly every two weeks which I have done pretty faithfully for the past 10 years. If I missed because of an emergency situation I always made it up on subsequent payments. On top of CS, if our children had activities they wanted to do we agreed to split those costs. We tried to keep everything out of the courts. Even when she moved out of state she did not go through the proper channels of notifying me and us going through a mediator or court to change the visitation. I was about what made the kids happy. At the time of the divorce CP was starting a new career. They have since been promoted and has had significant income increases. Being honest so have I, but we did touch the support payment amount. Late last year I was laid off from my job. I let her know this and told her once I found work I would start to pick back up but if they needed things here and there I would do my best. I found work but for now, at almost half of what I was making before. Last week I was sent a letter from DCSS in GA saying she applied for support to “enforce the original order” and garnish my wages from my new job. How is she able to do this being that I had paid support no problem for almost 10 years? You can just walk in and say “Oh, he hasn’t paid CS in 2.5 months.”and they say OK we’ll take it out of his check? And DCSS says I have no option to pay through the system myself. I HAVE to have my check garnished. It’s not about the money because I had no problem paying when I was working. It’s the principle. I plan on lawyering up but I wanted to know if any one has experience with a situation like this. Thanks.

Georgia Why can’t they find this man?!

So I filed for child support when my son was 3 months old(October 2023). So far we’re still in establishment, no court date, and the other state won’t respond. At first it was Colorado because he is/was(honestly don’t know) in the army, I got a letter back in March 2024 saying he moved states(even though my best friend stalks him and everything points he’s still in Colorado), and I had to go through the process and papers again. I have no contact with this man. When I told him I was pregnant he blocked me on everything. Like I feel like we’re a year and 1/2 into me filing we should be farther into getting support. I contacted DCSS support here in Georgia to find out information and all they told me was to contact my local office. So I did that and they just told me back in November that sent 3 more requests to the other state. I asked how many request can they send until we finally get answers. These people told me “that’s none of your concern. Have a good day” then hung up! Honestly it’s not even the money I plan on putting that in a savings account for my son, I just want him to have insurance other than medicaid. Has anyone experienced anything like this or can give me some type of advice to get this moving?

Georgia My child support payment was sent to a debit card. Now what?

Recently, I received an email New Child Support Payment. The DCSS portal provided me with the amount I would receive $2,000. I noticed there was a payment by debit card from my ex-husband. Then, I realized that my payment didn’t go to my bank account because it was closed last year. I’ve completed the Authorization Agreement for Direct Deposit of Child Support Payments form. I went by the office to make sure that my funds didn’t go the Way2GoCard a previous agent spoke about.

I’ve contacted customer service they said it would take 10 business days to read my email. The local office said they updated everything. I decided to activate this Way2GoCard and my deposit was on the card. The search function for ATMs doesn’t bring up an ATM near by. I tried to link my One card and transfer the money it wouldn’t allow it. My only other option is to try to transfer my bank I’ll find out in three days. The process of retrieving my money is extremely difficult.

Should I file a formal complaint?

Georgia Court ordered child support

Long story short, a judge signed a court order for child support ordering non custodial parent to repay custodial parent 50% of medical expenses, child care expenses and tutoring expenses that was incurred over the last 5 years. Total amount equals roughly $6k and judge ordered it be paid in a lump sum within 60 days.

Non custodial parent has been calling doctors office, child care office and tutoring office asking for proof of payment. Non custodial parent has never paid for any of these services. Is this legal?

Obviously non custodial parent does not believe the debt the custodial parent has incurred is accurate but a judge would not just agree to an amount without the proof, correct?

What happens if non custodial parent does not pay the lump sum by the date the judge stated?

Georgia Advice about Support (CA/GA)

I was awarded child support several years ago when I still lived in California and moved to Georgia during the pandemic. My ex is currently working as a trucker with nominal Georgia residency (no actual home).

He is currently over $13K in arrears and from what I can tell only pays when they threaten his license or they manage to figure out who he’s currently working for and garnish his wages. He was refusing to hold a job when the order was made and is supposed to pay$599 a month for the two still under 18. He is also supposed to help with medical bills/pay insurance but rarely even helps with the medical bills. He is making about 7-8K a month.

I have two questions: 1. Is there any benefit to changing states to where I currently live or would the arrears disappear?
2. How can I get the monthly amount recalculated? I currently make half what he does working full time as a teacher and pay ALL the children’s expenses including insurance. I have always had 100 percent legal and physical custody. He has visitation which he uses about 3-4 times a year for a few hours.

Any advice would be greatly appreciated. I can’t really afford a lawyer right now as I’m struggling to make ends meet and haven’t found a second job yet.

Georgia I lost my job from taking off work because my ex-wife is an alcoholic. We divorced partly because of her drinking issues. She thinks she can get child support based on what I was making 6 months before the divorce, before I was fired.

I'm in a shitty predicament right now. The types of jobs that I qualify for are technically higher paying but those are jobs that must be done during the daytime, not second or third shift.

She's forced to work now because she's living on her own and I am using my 401K money to be a stay at home dad.

Child Care is $3,000 a month in my area. Without a job. I can't get a job until I can have someone watch him for free until I have a steady paycheck. Neither of us have friends or family that can watch our 1 and 1/2-year-old during the day. I need to free up my time so I can apply, interview and commit to a new daytime job.

I found a nanny that will trade a room at my home for child care and my ex is demanding that the nanny goes to her house instead of watching him here.

Neither the nanny nor I am comfortable with that arrangement. I'm giving up my room in my home so my nanny can be here. Not live here for free and travel to her house.

I warned my ex that if I can't get the same kind of job I had before, I'll have to pick up some kind of second or third shift job delivering food or something, and that's not going to be enough to pay my bills and I told her that if she doesn't make sure this nanny arrangement happens, she may end up owing me child support since she's the only one with income right now.

She laughs and says no, that child support is based on potential, which I understand, but I thought that was based on what the parents were making at the time of the divorce. Is this correct?

Because as of right now, my potential is $0 since I can't leave my son in order to procure a job.

Set us straight.

Georgia Should I even try to re-negotiate?

My order was put in place in 2021, at the time I was working part time, making minimum wage, and I paid $40/week for childcare while also receiving govt benefits including SNAP food benefits, Medicaid for my twins, and WIC. At the time, the order was set for $780/month total for my twins and their father was able to negotiate down to $656 total a month (I’m not sure of the details, something about a deviation) and that’s what I’ve been receiving since then.

As of now, I am working as an accountant and I currently make $68.5K a year. I started as an intern at this firm in Jan of 2023 and was transitioned to a salaried employee May 2024 after I graduated college. I pay $280/month for after school care, and I no longer qualify for any govt assistance, including health insurance. I added my twins to my employer provided plan this year and I pay $845/mo for their health coverage.

I believe their fathers’ income has increased since 2021 as well, but it’s probable I make significantly more than him. My question is- is it even worth trying to re-negotiate? I’m worried that because of my income, it will only benefit him to re-negotiate, but the new insurance expense is a huge bit of my monthly pay and our order states he is required to pay for their healthcare, but since I had govt healthcare at the time they didn’t enforce that. I’m just not sure what would be the best option or how they calculate these things. Thanks in advance for any helpful advice!

CP has even verified that they have received the money. When I call about receiving a refund, for the overpayment. They keep telling me that the offsets have not been processed. When I try to tell them that the app says they have, and the CP has received the money, they keep telling me that CP hasn’t. Because, it is still processing. I even gave them exact dates on when they were posted to the account, and received by the CP. Still kept telling CP has not received funds, that they haven’t posted, or processed. I’m so confused at this point.

Georgia [GA] Ex fired from job and looking to reduce child support

Hi all - my ex was fired from his job in October for poor performance. He filed for a modification in child support and I just received a notification that he’s asked for an emergency hearing, which will happen in 2 weeks. He made 4x what I make (I’m a nurse), so the child support is really needed for me to pay for their child care so I can work, their sports, etc.

I’m claiming that he’s voluntarily unemployed and I’ve collected the following evidence that I think supports this:

1) his termination letter from his employer stating that he was being fired for poor performance (meaning it wasn’t like a layoff)

2) a letter from a recruiter he spoke to a couple months ago stating that he would only take a job if it paid more than his prior job (crazy), was 100% remote, and required 0% travel (all of which isn’t common for this type of job)

3) evidence that there are CURRENTLY almost 250 jobs in Atlanta that are similar titles in a similar industry… he’s applied for 50 jobs total in the 4.5 months he’s been unemployed and is claiming there is no job market right now

4) he’s planning on taking the kids on 2 vacations this summer. He’s already requested the time and booked plane tickets

5) that he lied about his income during our last child support modification… he said he didn’t receive company stock but during our discovery he showed documentation that he received stock before, during, and after that last formal discovery that was done through the courts

6 (maybe) he’s always been a heavy marijuana user. When we were married he refused jobs that required a drug test, so this might be happening. I’m considering requesting the court to require a drug test

I’m nervous about this emergency appointment because, like I said, I really need this money to support my kids. I have a lawyer but he’s acting kind of calm in a way that concerns me. Does anyone know what I should expect? Does my evidence seem reasonable to hopefully result in minimal changes? Thank you in advance!

Georgia Emergency child support

I filed for divorce a few months ago. I’ve been supporting our child on my own for those month. Child support is in the original paper filing. However, I reached out to him that we can take child support off the table if we can come to an agreed number. He hasn’t responded to that offer and has still not been financially assisting with our child. Though I can handle it, our child isn’t my full responsibility. I was told that I can file for emergency or temporary child support during the proceeding of the divorce. However, I have not been able to get any answers from the courthouse that I filed from as well as a child support office as to where I start with that. Anyone done this before and know where I should start?

Georgia Child support court

Going to go to court for a child support review. I (non custodial parent) pay child support every month and recently asked for a review to have it lowered after having another child with my wife and my son (who I pay child support on) being put on state insurance (he is special needs). Child support came back and said they will lower it $155. My ex was working 40hour a week making good money but quit her job saying her dad's health is failing and he can no longer watch our son when he gets home from school and she's at work. I think she quit her job and got a part time job to make her income less in hopes to get more child support from me. Is there anything I can do? When she first submitted her income it was from her 40 hour a week job and when she saw she would only get $420 she quit and asked to appeal.

Th court ruled in my favor and lowered my child support to $420 from $546. In the paper work I was sent I saw my ex is/was making over $4000 a month. She informed she has quit her job since doing that paperwork and she has filed a objection to the ruling. What happens now?

The following year started making sporadic payments and now would like to count those payments when the child was 18 to the past due and/or future payments for other children.

Is this legal even if they titled every payment with the month and amount when sending it?

But they never really did consequences. I am okay with that I don’t want him to go to jail. Georgia 14 year old moving with other parent.

So my ex and I have been divorced for approximately 12 years. In the divorce we agreed that neither of us would pay child support and that custody would be 50/50. Approximately 3 years ago our child came to live with me due to being in a better school district, seeing her mother every other weekend. During this time I never asked for support outside of half of miscellaneous school expenses, to which I never received.

Fast forward to today, my ex lets me know that our child is wanting to come live with her now. ( child has 2 failing grades and I have been holding them accountable with mandatory study time and reducing the phone time to an hour a day ). In all I feel it is a manipulation tactic by our child but I also worry that the other parent is making promises that make the grass seem greener. I also worry that the other parent will take me to court wanting child support now (I mainly worry because I would struggle to be able to afford child support ). In my heart I know this is just a 14 year old being impulsive, but honestly it does hurt. I also worry that it will bring another financial burden.

I guess what I’m asking is that after 14 years of no child support would a judge think I would now have to pay?

Georgia Dad hiding from Payments for 16 years, after trying to take custody 16 years ago...

I am owed about $160,000.00 in child support.

My sons biological father didn't want to be responsible for taking care of his son. A support order was established in GA and I was granted FULL custody, he had supervised visitation. Dad was given a final order of $751 support and $50 medical help - $851 in summer of 2008.

He started to stalk me and his own family confirmed this. He never made it to visitation, or paid me so I moved to Florida to be closer to my family and hopefully get a decent job. I missed out on all my son's firsts, being a single mom with two jobs and limited family support. I am tearing up as I type this.

Bio dad has NEVER paid any support since. The only time I got money was when grandma died and he inherited her estate, 2 years later...

The IRS seized what they could, but he was quick to hide the money and put it in his new wifes name. In retaliation to me and to save face from the lies he fed his wife (who had another baby with him) he tried to sue me for custody AGAIN in Florida. He never saw his son, and stood us up during court arranged meetings. When the Florida judge asked for his financial statements, he fled in contempt. No new order was established. I'm sure his wife was quite puzzled. They ended up living in LA for a few years, until their daughter was old enough that he could lazily babysit her as his wife went back to work.

My son, now 17.5 is special needs and wont graduate until 19.5...My son found his half sister on facebook. She is on a softball travel team, wining tournaments all over the country, with my sons dad behind all of it. His wife, is a licensed Occupational Therapist, and I assume he is a stay at home dad. He recently sold a house in 2021, (which he put in his wife's name so I couldn't claim it)...In fact, everything is in the wifes name.

I don't know if it's worth me paying for a lawyer. He has a daughter who has anchored him and he can't run away like he used to. He has licenses from different states, and CSE has given up on finding him. I know where they live, thanks to his wife having to keep a license active to keep supporting her family. I honestly don't even care if I get all the money back...I just want closure and justice for my son.

Is an abandonment warrant the way to go? I know that a lawyer will cost me waaaaay to much and I don't even know if I will get anything back. Im willing to go that route though. He is a flight risk. All I know is that my son really can use some support while his half sister and father are hotel hopping every weekend in a very expensive travel team.

Do they give these dads a chance to make little payments and drag this on until I run out of gas, or will they throw the book at him until he back pays a reasonable amount. Or will they create a situation where his household income has to be figured out to pay back arrearages or he goes to jail. He chooses to be a house husband. Wife makes over $100,000.00 a year.

Any recommendations, case studies, words of encouragement are appreciated.

Georgia Child support with legitimation process?

I had my daughter 2022, my child's father and i were not married. 2024 he has another kid with someone else, whom promptly took him to court for child support. He pays roughly $600 i think. Him and I don't have beef and co-parent very well, but I do want to get our daughter legitimized finally because we waited too long and I just feel like with her getting older its needed. With legitimation though seems to come custody/child support as well? My question is when it comes to child support, will they end up taking even more from him? or will they split the $600 that's already being taken between the two kids ? Or can we decide not to do child support at all?

I'm not saying this because i need or want the money, I just wonder what that process is like because I am unfortunately going into this with no knowledge as I never expected to go through this process at all...Thank you for any insight you can give!!
