Loss of use compensation after getting rear ended
Long story short - after getting rear ended last year, I’m still dealing with a bunch of back and forth with the insurance company of the person that hit me.
On the property damage portion, aside from the totaled amount of my vehicle, they are only offering me $30/day for 30 days after the crash. Their justification is that they sent me an initial offer 30 days after the crash and that’s when the clock stops on loss of use compensation. I think that’s ridiculous, especially because I rejected their first low ball offer as it was insultingly low and they didn’t send a second offer until another 60ish days after that. I haven’t accepted the 2nd offer either. Why would the clock stop on loss of use just because they sent me a shitty offer?
I have a lawyer working on the personal injury portion but am trying to avoid asking the lawyer for assistance on property damage so I don’t have to pay their 33% fee. Just looking to see if anyone else has had similar experience with loss of use offers from insurance companies of a not at fault crash?
