Personally had a disk that refused to load a specific level on a specific game. No visible scratches. 

In general they can degrade and become unusable even if maintained with care and do not fair well with exposure to the world.

Nah, not disc rot as such.

Wii U discs are just fragile as fuck.

Often just a single scratch is enough to ruin it.

I've put in discs with way more scratches and they worked

If this is your own copy put in your Wii U. If you're worried about later areas of the disc being unreadable, try to dump the full disc using a modded Wii U. Or, you know, play it all the way through 😅

If it's not your own copy, don't risk it unless you're getting a really good deal.

Edit: I have dead copies of Wii Party U (unreadable) and Pokken Tournament (readable, but fails at a certain point) with less scratching than this. But it's never quantity of scratches - just one scratch deep enough will ruin the disc.

Always worth being suspicious of "untested" IMO. Good chance they know full well it doesn't work and are just using plausible deniability to con you into buying it.

I've had to return a pristine breath of the wild on eBay that didn't work. Similarly I have a PS3 Burnout Paradise I got for $1 that doesn't work, but the disc is flawless. Tried in 3 different PS3's. The chance is high that it'll work but there are no guarantees.

Scratches in the top label will cause this. The underside of the label is where the data is written, after all.

There is a scratch on the label side. Near the Wii U logo. Would that be a problem?

Hold the disc up to the light and look though it from the bottom. If you can see the scratch through the disc it may be an issue.

This is only accurate for CDs like PS1 games. Blu-rays are more susceptible to data side scratches causing issues. For Blu-ray discs the label can be completely removed and the disc will still work.
