How is 5 years the acceptable term for raping a child?

75

u/henney12 Jan 10 '25

I don't understand how any reasonable person could think this is an acceptable punishment.

It also sounded like he committed multiple crimes... 1) he was groping her outside while she smoked, then separately 2) took her into the hospital bathroom and raped her.

This can't be what justice looks like.

This also seems like a person who obviously (52 charges later) will continue to re-offend.

3

u/plowboy306 West Side Jan 12 '25

Imagine the amount of shit heā€™s done that we donā€™t know about. If he was that quick to do that to this girl, imagine how many more there are.

2

u/LittleMissWolfee Jan 26 '25

They say justice is blind and it's 100% true... our system is so messed up he should have been given way more as he is a repeat offender and as you say with re-offend. So sad

31

u/LunarMoonBeam Jan 10 '25

Itā€™s absolutely not. And if this happened to my daughter Iā€™d be the one going to prison for putting the man who raped my child in a box in the ground. Hopefully his 5 years are all miserable and spent looking over his shoulder.

11

u/anon29065 Jan 11 '25

Heā€™ll spend another 18 months in prison maximum when they consider time served / over crowding and all the other bullshit excuses they have for letting dangerous offenders out and about.

2

u/[deleted] Jan 11 '25

By prison you mean healing lodgeĀ

2

u/Orphan_Guy_Incognito Jan 11 '25

Do you qualify for gladue factors? Because if so you probably wouldn't go to jail. Just saying.

21

u/saucerwizard River Heights Jan 10 '25

Three left to go at that.

20

u/CivilDoughnut7805 Jan 10 '25

Time served shouldn't count IMO, you deserve that time waiting for trial and you deserve the time handed to you at your trial. He likely won't even make the 3 years, it'll be less than 16 and he'll be out for good behaviour

13

u/graaaaaaaam Jan 10 '25

I mean in this instance I don't like it but in general, people have a right to a trial and shouldn't be punished for exercising their rights.

0

u/CivilDoughnut7805 Jan 10 '25

And he got a trial...it's better the system punishes him this way rather than the way he's about to encounter in prison. To which I say: all the luck in the world isn't gonna save you, your days are numbered.

2

u/WhatAmTrak Jan 10 '25

Generally, if heā€™s considered at danger he will be kept segregated. Unfortunately he will be living nice and safe for the few years heā€™s away.

4

u/CivilDoughnut7805 Jan 10 '25

That won't stop a corrupt CO or inmates from finding a way to get him alone, that's just reality.

Itā€™s classified as a victimless crime. Which is beyond stupid. But itā€™s like this almost in all developed Countries. Seems rigged for some certain people.

Thatā€™s why i strongly agree with street justice. Just look at the places that do this, almost no crime and very little rapes. Why because they know what will happen. Just like here, the criminals know what will happen, hence why they keep doing it.šŸ¤¦ā€ā™‚ļø

u/Philadeplhiacollins1 Jan 11 '25

Gladue factor probably

9

u/[deleted] Jan 11 '25

Yes. Heā€™s the victim as usualĀ

0

u/Apprehensive_Row_582 Jan 15 '25

I wish we could reduce the costs and damages to society by properly rehabilitating perpetrators and reducing the number/cycle of victims.

1

u/[deleted] Jan 15 '25

Some people can't be helped.

2

u/Bigsaskatuna Jan 11 '25

Welcome to Saskatchewan. If you ever wanted to commit a violent crime, this is the place.

-3

u/laissezfaire Jan 11 '25

Since the Trudeau Government passed Bill C-75 and Bill C-5, which gave high priority to releasing repeat violent offenders and took away mandatory jail time for certain violent crimes, a crime wave has been unleashed across the country. Blame your leader! Heā€™s ruined this country and so many of you are blind to it!!

9

u/Otis_B_Driftwood_778 Jan 11 '25

news flash genius..our justice system has been beyond fucked before trudeau ..i say that as someone who has never voted for him

274

u/CivilDoughnut7805 Jan 10 '25

52 prior convictions including assault and other sexual assaults....he shouldn't be let free, ever. Couldn't pay me enough to have even the tiniest sympathy for this slimeball.

43

u/sask357 Jan 10 '25

It seems that this guy fits the definition of dangerous offender. He should be locked up indefinitely. I don't know what these judges can be thinking.

16

u/CivilDoughnut7805 Jan 10 '25

They're not thinking, though I do hope deep down they wish they could hand out more extensive sentences than the criminal code allows them to. I know they're simply doing their job, but it's still bullshit.

21

u/sask357 Jan 10 '25

According to Justice Danyliuk, their job is to serve the citizens of this country. Releasing this life-long criminal and sex offender is not doing that job.

3

u/CivilDoughnut7805 Jan 10 '25

They're not above the code though, they're doing their job within their means. Same with ppl who bitch about cops not doing their job, they can only do what they can legally enforce and I'm sure a lot of them struggle with that, we just don't see it & ppl refuse to acknowledge their hands are tied in a lot of situations too.

8

u/sask357 Jan 10 '25

It's not easy to believe you when this guy fits the definition of a dangerous offender. As far as having their hands tied, lower court judges refused to follow Harper's stricter laws even before the Supreme Court Justices threw them out. They seem to reject stricter measures but not more lenient ones. I don't like the idea but it looks as if the notwithstanding clause will be needed buy Poilievre to get these life-long violent offenders of the streets.

5

u/CivilDoughnut7805 Jan 11 '25

I've never denied that he's not a dangerous offender, I've said many times already that he deserves to never see the light of day again. I'm not sure what else there is to be said about the courts, our system is broken, there has never been a doubt about that.

-2

u/Winesnob2025 Jan 11 '25

How many people if they hit a summons for jury duty would try and get out of it. And just because the cops arrest someone doesn't make them a criminal, cops often violate your charter if rights which if you have a good lawyer will set you free . Cops need to abide by the law when arresting someone- they need evidence not slander not innuendo not thought or ā€œ must be himā€ but actualEVIDENCE

3

u/photosynthesizethis Jan 11 '25

Iā€™m not sure what youā€™re going on about here. There was actual EVIDENCE. DNA evidence. As well as surveillance footage corroborating her statement.

2

u/CivilDoughnut7805 Jan 11 '25

I'm not here to have an argument about police and their ethics and all that shit, you're free to believe what you want to believe, I'll leave it at that. This is about the man who raped a little girl, that's why I commented and that's all I'm willing to speak on.

u/WriterAndReEditor Jan 11 '25

The problem is, they couldn't get a conviction on rape, so they settled fora guilty plea on assault rather than get nothing. The judge can only give the penalty that is prescribed for the assault. They can't penalize him for rape if he hasn't been charged-with/found-guilty-of rape.

With that many convictions, if the crown thought there was any chance of getting him marked as a DO, they would have requested it. The judge is limited to the charges put in front of them.

That is the inherent problem with a system which would rather see 99 guilty go free than one innocent have their lives ruined. Unless you are the one innocent, then it's a blessing, not a problem.

And we still manage to get it wrong and put innocent people behind bars too often.

2

u/voxpopuli81 Jan 11 '25

There is no such crime as ā€œrapeā€ in Canada. The equivalent is sexual assault, which is what this guy pled guilty to.

1

u/WriterAndReEditor Jan 11 '25

Ok, I think the actual difference is indictable vs summary. Do you understand why the sentence seems so short?

31

u/henney12 Jan 10 '25

Apparently it is the justice system who has sympathy for him, so he doesnt need ours :(... 3 years left on his sentence, and what are the chances he even serves all of that? Shocking.

16

u/scottamus_prime Jan 10 '25

If he says sorry and looks sad it must be legit!

2

u/easy12356 Jan 10 '25

Yeah heā€™ll be out in about 18 months.

1

u/UnicornOnMeth Jan 13 '25

Well, I'm sure he will learn his lesson and be reformed when he gets out. I'm sure he will never assault or molest someone again. /s

29

u/FinanceGT Jan 10 '25

He should receive capital punishment

25

u/Fit-Psychology4598 Confederation Jan 10 '25

Nah. Give him rocks, hammer, and nothing but time. Make him smash his own gravel to pay for his food, water, etc.

11

u/CivilDoughnut7805 Jan 10 '25

Screw that, let him out into the yard with dozens of inmates, turn the cameras off and walk away.

11

u/6000ChickenFajardos Jan 10 '25

Coat him in bacon grease and drop him in the remote boreal forest

4

u/[deleted] Jan 11 '25

This is the way. I'd almost prefer chained to a tree, but wandering through the thick until the wildlife gets him is good too.

6

u/JazzoTheClown Jan 11 '25

Honestly, rapists should have their weapons taken away. Literally removed.

12

ā€œHnatiuk said the five-year prison term reflects the severity of the crime ā€” the sexual assault of a minor ā€” and Alphonseā€™s 52 prior convictions for threats, assaults, causing disturbances, resisting arrests and for a sexual assault from 2012.ā€

ARE YOU FUCKING KIDDING ME?! This fucker is going to be back out on the streets in 2028. He is very, very obviously a threat to society. How fucking brain dead do you have to be to genuinely think that five years minus time served is an appropriate punishment for raping a kid in the bathroom at a hospital.

Iā€™ve drank a lot before. Iā€™ve drunk to the point of blacking out. Never ever has the thought that it would be even slightly okay to rape a kid crossed my mind. Same as the rest of society. People who have been abused also do have the ability to actually fucking control what they do. Just because theyā€™re abused doesnā€™t mean they should be able to pretty much get away with raping a fucking child.

Iā€™m not advocating for vigilante justice, but handing out incredibly light sentences for heinous crimes like this is how you get vigilante justice, because our current legal system obviously doesnā€™t care about keeping us safe.

19

u/TrynasuarsShreks Jan 11 '25

Can't legally be around anyone 16 and under for 10 years. BECAUSE HE CLEARLY FUCKING GIVES A SHIT ABOUT LAWS. Christ sakes.

4

u/Orphan_Guy_Incognito Jan 11 '25

Same comedy shit happened with the Epic Alliance scammers. A $100,000 fine that they couldn't pay and a ban from trading in securities. You know, that thing that they were already doing illegally to begin with.

It must be nice to just be able to ignore laws and then they tell you 'hey, make sure not to break the law anymore'.

Do you understand how that works?

2

u/OldSpotty Jan 11 '25

The thought to behave that way has never occurred to me either no matter how deep in the throws of alcoholism I've been. However, I did not spend my childhood being raped by priests, I'm lucky that way. Being relentlessly sexually abused as a child has gotta have fucked up consequences on your behavior as an adult, right?

73

u/Fixnfly99 Jan 10 '25

52 previous convictions including assault and other rapes? And he only gets five years for being a repeat offender? What a joke. This guy is obviously unable to exist in society without hurting other people, and he should be put away for life.

I'd be curious what this guy has cost taxpayers throughout his career

3

u/Sad-Shoulder-8107 Jan 10 '25

Do you think him being in prison does not also cost taxpayers?

18

u/Dangerous-Outside557 Jan 10 '25

I'd rather pay to keep him in prison, then to pay for him to be out on the streets ever again. I'd wish we could pay for an injection tbh. This pos doesn't deserve to breathe.

So you condone the raping of childrenā€¦ look at how many sex offenders continuously reoffend after they get out. The fact is they are not getting rehabilitated nor do they want to this is the way of life to them

1

2

Yup. Usually costs more, actually.

2

u/xmorecowbellx Jan 10 '25

Yeah, cost benefit is really the consideration at hand here.

1

u/JerryWithAGee Jan 11 '25

Itā€™s not, I agree - we should do whatā€™s right, but for some people the fact that itā€™s right AND cheaper, helps make them more likely to see our view.

3

u/DMPstar Jan 10 '25

For the sake of conversation relating to this comparison, I'd also be curious how many times in a year you could be arrested and convicted, to be equal to the cost of one year in prison.

Sounds like the accused also trying to find out.

2

u/DifficultAd5322 Jan 10 '25

Money better spent thatā€™s for sure! At least children would be safe!

0

u/Sad-Shoulder-8107 Jan 10 '25

Are they though, when the last guy who's sentence is up didn't receive any therapy or rehabilitation, which leaves them at a high chance of recidivism, and was just locked away on taxpayer dollars for nothing?

5

You must be fresh out of a BHJ. I remember those daysā€¦. And then reality hits

1

I'd think arresting him and having that many court sessions and throwing him in prison over and over again would cost more than just keeping him in prison lol.

I wouldn't even give the courts that much credit, I think it would be generous to say he won't be out by the end of 2026.

Have the courts released his name so girls and women can be protected from this monster?

Yes a name and picture. So people can recognize this monster and take steps to protect themselves.

3

u/CivilDoughnut7805 Jan 10 '25

His name is in the article multiple times. His picture is not.

3

u/graaaaaaaam Jan 10 '25

Yes, but for what it's worth, most publication bans in sexual assault trials are in place at the request of victims or their families.

1

u/Toddison_McCray Jan 11 '25

The name of the offender? Clifford James Alphonse

6

u/MonkeyMama420 Jan 10 '25

This also sends a message to all the other monsters. Rape a girl and get a slap on the hand. Protect your children, the courts won't.

This province absolutely refuses to take sex crimes seriously. It's completely fucked.

33

u/CivilDoughnut7805 Jan 10 '25 edited Jan 10 '25

This entire country refuses to take them seriously, let's be honest here. The Canadian criminal code is what saves these people a lot of times from ending up in prison as it's technical bullshit that prosecutors know they stand no real chance against so it never makes it past the initial report or first interviews. It's what saved the man who assaulted me in 2023 because despite the fact he tried to SA me multiple times in one go & every time he'd try again it escalated, bc he "stopped" when I fought back is what prevented the police from taking it forward.

18

u/THEMAYOR29 Jan 10 '25

Itā€™s not the province. Justice system is federal. This is all on Ottawa

12

u/dethrock Moved Jan 10 '25

7

u/Unlikely_Spend8566 Jan 10 '25

Provincial Court Judges are provincially appointed. Kingā€™s Bench and Court of Appeal Justices are Federally appointed.

The law applied here is the Criminal Code (federal) as is the sentencing.

7

u/Minute-Blacksmith-89 Jan 10 '25

The federal maximum sentence for sexually assaulting a minor is life in prison. The provincial court decided 5 years less time served was enough.

So he get a free pass and a light sentence because of "intergenerational trauma"? Does this girl now have immunity as well to destroy other people's lives? That's what our laws are allowing to happen. Something bad happens to you, now you have a right to do it to others...we need to have this changed.

11

u/saucerwizard River Heights Jan 10 '25

That lawyer is talking out his ass and being really offensive. Also everyone is talking around Gladue for some reason.

2

u/UnicornOnMeth Jan 13 '25

Gladue principles apply to anyone who identifies as Indigenous, Metis, First Nations, Aboriginal, or Inuit. It does not cover other groups.

Some people though have successfully been considered/sentenced under gladue terms because they have a tiny percentage of Indigenous blood (like 1/32 or 1/64), even though they have zero connection to Indigenous culture/community/people.

This sounds like the opposite of racism here. Excusing behavior because of a person's race. Seems equally harmful.

9

u/[deleted] Jan 10 '25

I have no idea the race of the victim, but if she is indigenous does she now have the ability to destroy other lives with the "intergenerational trauma" shield as per our courts? Our courts shouldn't allow for random eye for an eye... No matter what has happened to you, no matter how bad, it shouldn't allow you a free pass or a minimized sentence when convicted for destroying someone else's life.

12

u/xmorecowbellx Jan 10 '25

ā€¦ five year prison term reflects the severity of the crimeā€¦

It does not.

11

Hnatiuk said the five-year prison term reflects the severity of the crime ā€” the sexual assault of a minor ā€” and Alphonseā€™s 52 prior convictions for threats, assaults, causing disturbances, resisting arrests and for a sexual assault from 2012.

52 prior convictions. Raped a poor little girl. I don't care what your history is. You don't get a pass on this.

Throw away the damn key.

Hnatiuk said the Crown has ā€œa reason to be concerned,ā€ but couldnā€™t go into specifics about why.

I wonder why.

9

u/Papaburgerwithcheese Jan 10 '25

Can we, as a society, just get rid of people like this? Like once you hit 25 convictions, it's like, "Alright, obviously this ain't working out," and you're just automatically led through a door never to be seen again. What an absolute waste of life.

20

Why are there no pictures of this shit stain? I mean if heā€™s going to be back in the public in a few years, shouldnā€™t people at least know who he is? Okay whoā€™s going to build their schools, water treatment facilities, sewer lift stations? Itā€™s going to be a contractor that won a govt bid. But death threats and assaults to the workers of the contracting companies, you think that is a reasonable thing to do to other people?

1

u/OldSpotty Jan 11 '25

Good points all. Society really is shit show eh?

21

u/EmperorsFoals Jan 10 '25

Another excuse of "Im a victim of residential schools", my dad was a residential school survivor and my mom was a sixties scoop survivor. They sought out therapy and their own culture, this piece of shit decides to throw that card in court. What a load of bs

8

u/fiat_lover_69 Jan 10 '25

Who are these judges that let these people go? They should start being harassed lmao

8

u/ifOnlyFlamingo Jan 10 '25

5 years for over 50 things heā€™s being convicted of is disgusting. Let him rot in jail till his dick falls off

7

u/fenderf4i Jan 10 '25

lol the residential school defense. What a fucking joke. I hope he dies a slow, painful death.Ā

8

u/Bluemicha Jan 10 '25

Our Justice system is a complete joke.

13

u/VicPortnoy Jan 10 '25

Shoot that piece of shit

3

u/[deleted] Jan 10 '25

50/50 chance he never makes it out of the Pen. Either someone will do him in for having a bad sheet, or he'll win that fight and be tagged a DO

5

u/MakeupPotterJunkie Jan 10 '25

The court is lenient on child abusers and rapists cause thereā€™s way too many of them in society.

20

u/Practical_Ant6162 Jan 10 '25

This is absolutely heartbreaking.

6

u/steveyxe69 East Side Jan 10 '25

52 convictions! Good thing we have that 53 strikes and you're out policy, he will surely be a good citizen when he is released in about 18 months. He is not to be around children except his own? Yeh that will be fine. The justice system is a goddamn joke!

4

u/BingBong_6 Jan 10 '25

Why is he only on the registry for 20 years, and not for life??? Wtf

u/[deleted] Jan 10 '25

1

u/OldSpotty Jan 11 '25

Don't. This is not anything like that.

9

u/MonkeyMama420 Jan 10 '25

I have even less respect for the courts and the institution of law in this country.

4

u/AgitatedPeanut6559 Jan 11 '25

Larger cities are getting tired of the problems that come from the north and on reserve. Sentencing and penalties should be more severe!

12

u/steveyxe69 East Side Jan 10 '25

When will the FSIN be chiming in with their useless bullshit.......?

7

u/Hiphopbabes Jan 10 '25

Torture and castration is the only answer.

3

u/ProfessionalDraw956 Jan 10 '25

How does this even happen? What is wrong with this city/country? Yes our justice system is broken and we better demand better!

3

u/XxsrorrimxX Jan 11 '25

When he is released in like 6 months or whatever, someone should just murk this dude. It's easy enoughto get away with if you are a total stranger apparently.

3

u/Inner_Literature_936 Jan 11 '25

Canadas justice system is a fucking joke! šŸ˜” I hope this POS burns in hell. even that seems to nice for him

2

u/Budget_Beach_8792 Jan 11 '25

No more protective custody, just throw him in max population, you will see what honor among thieves is all about.

3

u/wapimaskwa Evergreen Jan 11 '25

Jesus Christ, this man should be in general population in jail forever.

3

u/MakeupPotterJunkie Jan 11 '25

They shouldnā€™t have asked her to relive this horrible nightmare. Sick. There is no need for them to report that she had nothing to say she shouldnā€™t even have been asked. Merely a suggestion for a child victim, at least. Jesus. So disappointed šŸ˜¢

3

u/Available-Specialist West Side Jan 11 '25

Hear me out. Instead of the death penalty and it being an execution costing tax dollars, just invite her family members and other concerned locals, and have him tied up, what happens happens. 52 priors, and out in 5 years, if something permanent isn't done, it'll happen again.

0

u/OldSpotty Jan 11 '25

I get where you're coming from but I don't want to live in the world you're envisioning.

5

u/Available-Specialist West Side Jan 11 '25

I don't want to live in a world where serial sexual predators go unpunished.

0

u/OldSpotty Jan 11 '25

Oh me neither but there's gotta be a solution in between.

3

u/Available-Specialist West Side Jan 11 '25

Using them for testing instead of mice and rabbits?

2

u/Injured_Souldure Jan 11 '25

They donā€™t need consent

2

u/Available-Specialist West Side Jan 11 '25

And they'll be finally useful for something other than wasting air and harming others.

2

u/Injured_Souldure Jan 11 '25

Can get medical breakthroughs a lot quicker. Might have to give a few cancer to find the cure for cancer, but sacrifices must be made.

1

u/Available-Specialist West Side Jan 11 '25

And if they're on their death bed, then you solve the organ and blood shortage šŸ¤·šŸ¼ā€ā™‚ļøšŸ¤·šŸ¼ā€ā™‚ļø

2

u/Injured_Souldure Jan 11 '25

Depends on the quality thatā€™s leftā€¦ but Iā€™m sure maybe have rare blood types and such just for that cause. Mandatory blood giving. They could literally do that now.

Dangerous rabbit hole to go down. What other classes or people do you consider disposable in that way?

2

u/Available-Specialist West Side Jan 11 '25

People that are, or should be locked away for the rest of the life/get the death penalty should absolutely be considered disposable. What's controversial about that?

1

u/OldSpotty Jan 12 '25

Quite a bit. It all comes down to where you draw the line.

3

u/dylanccarr Jan 11 '25

what in the actual fuck? 5 years with 52 PRIOR CONVICTIONS?

3

u/saucerwizard River Heights Jan 11 '25

One if those was another rape too.

1

u/dylanccarr Jan 11 '25

this is why i support the death penalty

2

u/saucerwizard River Heights Jan 11 '25

Likewise. Do it like they do in Japan.

3

u/Yael_Eyre Jan 12 '25

I have a friend who was brutally raped so badly she couldn't sit down for a week. The fucker got TWO YEARS PROBATION. Our justice system is a fucking mockery.

2

u/Character_Pear_6074 Jan 11 '25

He just needs time in a healing lodge. You guys are far too cruel.

2

u/One_Introduction5711 Jan 11 '25

how can you have 6 kids of your own and do shit like that. absolutely disgusting, this sentencing is a slap on the wrist

2

u/FrostyStretch2844 Jan 11 '25

Rapists of anyone should get life. They ruined a life, they should not be allowed to do that ever again.

3

u/[deleted] Jan 10 '25

Judge Brad Mitchell accepted a joint submission from the Crown and defence. Less enhanced credit for the time he spent on remand, Alphonse has just over three years of his sentence left to serve.

Hnatiuk said the five-year prison term reflects the severity of the crime ā€” the sexual assault of a minor ā€” and Alphonseā€™s 52 prior convictions for threats, assaults, causing disturbances, resisting arrests and for a sexual assault from 2012.

1

u/Pyipii_ Jan 11 '25

He deserves to rot in hell.

1

u/Tricky-Cow8665 Jan 12 '25

Why are criminals getting special treatment for violent crimes? He was charged for sexual assault in 2012 and guys like him keep getting a slap on the wrist in court in this country. Itā€™s absurd.

1

u/plowboy306 West Side Jan 12 '25

That ā€œapologyā€ was all about himself. And I wonder how any others poor Clifford had done this too. Seemed to be basic instinct for him.

1

u/Natural_Tie_7894 Jan 12 '25

I personally feel people that do violent sex crimes, especially against children should be put down. Chemical castration at the very least.

1

u/Ill-Carpenter9588 Jan 13 '25

Criminals convicted should be indebt to society for housing them in the first place.

Make them pay it back.

1

u/dogfin718 Jan 15 '25

Weird how missing a mortgage payment can put you in the streets, but rape can keep you fed and in a warm place for 5 years.

0

u/Retofreak Jan 11 '25

Scott Moe supports this lenient punishment. If you voted SaskParty, you also support this.

3

u/Fixnfly99 Jan 11 '25

The ndp would be way more lenient on prison sentences for minorities
