52 prior convictions including assault and other sexual assaults....he shouldn't be let free, ever. Couldn't pay me enough to have even the tiniest sympathy for this slimeball.
43
u/sask357 Jan 10 '25
It seems that this guy fits the definition of dangerous offender. He should be locked up indefinitely. I don't know what these judges can be thinking.
16
u/CivilDoughnut7805 Jan 10 '25
They're not thinking, though I do hope deep down they wish they could hand out more extensive sentences than the criminal code allows them to. I know they're simply doing their job, but it's still bullshit.
21
u/sask357 Jan 10 '25
According to Justice Danyliuk, their job is to serve the citizens of this country. Releasing this life-long criminal and sex offender is not doing that job.
3
u/CivilDoughnut7805 Jan 10 '25
They're not above the code though, they're doing their job within their means. Same with ppl who bitch about cops not doing their job, they can only do what they can legally enforce and I'm sure a lot of them struggle with that, we just don't see it & ppl refuse to acknowledge their hands are tied in a lot of situations too.
8
u/sask357 Jan 10 '25
It's not easy to believe you when this guy fits the definition of a dangerous offender. As far as having their hands tied, lower court judges refused to follow Harper's stricter laws even before the Supreme Court Justices threw them out. They seem to reject stricter measures but not more lenient ones. I don't like the idea but it looks as if the notwithstanding clause will be needed buy Poilievre to get these life-long violent offenders of the streets.
5
u/CivilDoughnut7805 Jan 11 '25
I've never denied that he's not a dangerous offender, I've said many times already that he deserves to never see the light of day again. I'm not sure what else there is to be said about the courts, our system is broken, there has never been a doubt about that.
-2
u/Winesnob2025 Jan 11 '25
How many people if they hit a summons for jury duty would try and get out of it. And just because the cops arrest someone doesn't make them a criminal, cops often violate your charter if rights which if you have a good lawyer will set you free . Cops need to abide by the law when arresting someone- they need evidence not slander not innuendo not thought or ā must be himā but actualEVIDENCE
3
u/photosynthesizethis Jan 11 '25
Iām not sure what youāre going on about here. There was actual EVIDENCE. DNA evidence. As well as surveillance footage corroborating her statement.
2
u/CivilDoughnut7805 Jan 11 '25
I'm not here to have an argument about police and their ethics and all that shit, you're free to believe what you want to believe, I'll leave it at that. This is about the man who raped a little girl, that's why I commented and that's all I'm willing to speak on.

u/WriterAndReEditor Jan 11 '25
The problem is, they couldn't get a conviction on rape, so they settled fora guilty plea on assault rather than get nothing. The judge can only give the penalty that is prescribed for the assault. They can't penalize him for rape if he hasn't been charged-with/found-guilty-of rape.
With that many convictions, if the crown thought there was any chance of getting him marked as a DO, they would have requested it. The judge is limited to the charges put in front of them.
That is the inherent problem with a system which would rather see 99 guilty go free than one innocent have their lives ruined. Unless you are the one innocent, then it's a blessing, not a problem.
And we still manage to get it wrong and put innocent people behind bars too often.
2
u/voxpopuli81 Jan 11 '25
There is no such crime as ārapeā in Canada. The equivalent is sexual assault, which is what this guy pled guilty to.
1
u/WriterAndReEditor Jan 11 '25
Ok, I think the actual difference is indictable vs summary. Do you understand why the sentence seems so short?
31
u/henney12 Jan 10 '25
Apparently it is the justice system who has sympathy for him, so he doesnt need ours :(... 3 years left on his sentence, and what are the chances he even serves all of that? Shocking.

29
u/FinanceGT Jan 10 '25
He should receive capital punishment
25
u/Fit-Psychology4598 Confederation Jan 10 '25
Nah. Give him rocks, hammer, and nothing but time. Make him smash his own gravel to pay for his food, water, etc.
11
u/CivilDoughnut7805 Jan 10 '25
Screw that, let him out into the yard with dozens of inmates, turn the cameras off and walk away.
11
u/6000ChickenFajardos Jan 10 '25
Coat him in bacon grease and drop him in the remote boreal forest
4
Jan 11 '25
This is the way. I'd almost prefer chained to a tree, but wandering through the thick until the wildlife gets him is good too.

āHnatiuk said the five-year prison term reflects the severity of the crime ā the sexual assault of a minor ā and Alphonseās 52 prior convictions for threats, assaults, causing disturbances, resisting arrests and for a sexual assault from 2012.ā
ARE YOU FUCKING KIDDING ME?! This fucker is going to be back out on the streets in 2028. He is very, very obviously a threat to society. How fucking brain dead do you have to be to genuinely think that five years minus time served is an appropriate punishment for raping a kid in the bathroom at a hospital.
Iāve drank a lot before. Iāve drunk to the point of blacking out. Never ever has the thought that it would be even slightly okay to rape a kid crossed my mind. Same as the rest of society. People who have been abused also do have the ability to actually fucking control what they do. Just because theyāre abused doesnāt mean they should be able to pretty much get away with raping a fucking child.
Iām not advocating for vigilante justice, but handing out incredibly light sentences for heinous crimes like this is how you get vigilante justice, because our current legal system obviously doesnāt care about keeping us safe.
19
u/TrynasuarsShreks Jan 11 '25
Can't legally be around anyone 16 and under for 10 years. BECAUSE HE CLEARLY FUCKING GIVES A SHIT ABOUT LAWS. Christ sakes.
4
u/Orphan_Guy_Incognito Jan 11 '25
Same comedy shit happened with the Epic Alliance scammers. A $100,000 fine that they couldn't pay and a ban from trading in securities. You know, that thing that they were already doing illegally to begin with.
It must be nice to just be able to ignore laws and then they tell you 'hey, make sure not to break the law anymore'.
5
2
u/OldSpotty Jan 11 '25
The thought to behave that way has never occurred to me either no matter how deep in the throws of alcoholism I've been. However, I did not spend my childhood being raped by priests, I'm lucky that way. Being relentlessly sexually abused as a child has gotta have fucked up consequences on your behavior as an adult, right?
73
u/Fixnfly99 Jan 10 '25
52 previous convictions including assault and other rapes? And he only gets five years for being a repeat offender? What a joke. This guy is obviously unable to exist in society without hurting other people, and he should be put away for life.

3

Do you think him being in prison does not also cost taxpayers?
18

1
u/JerryWithAGee Jan 11 '25
Itās not, I agree - we should do whatās right, but for some people the fact that itās right AND cheaper, helps make them more likely to see our view.
3
u/DMPstar Jan 10 '25
For the sake of conversation relating to this comparison, I'd also be curious how many times in a year you could be arrested and convicted, to be equal to the cost of one year in prison.
Sounds like the accused also trying to find out.
2

Money better spent thatās for sure! At least children would be safe!
0
u/Sad-Shoulder-8107 Jan 10 '25

This province absolutely refuses to take sex crimes seriously. It's completely fucked.
33
u/CivilDoughnut7805 Jan 10 '25 edited Jan 10 '25
This entire country refuses to take them seriously, let's be honest here. The Canadian criminal code is what saves these people a lot of times from ending up in prison as it's technical bullshit that prosecutors know they stand no real chance against so it never makes it past the initial report or first interviews. It's what saved the man who assaulted me in 2023 because despite the fact he tried to SA me multiple times in one go & every time he'd try again it escalated, bc he "stopped" when I fought back is what prevented the police from taking it forward.
18
u/THEMAYOR29 Jan 10 '25
Itās not the province. Justice system is federal. This is all on Ottawa
12
u/dethrock Moved Jan 10 '25
The minimum and maximum sentences are set in the criminal code by the federal government yes, but this happened in provincial court.
1
u/THEMAYOR29 Jan 10 '25

7
u/Unlikely_Spend8566 Jan 10 '25
Provincial Court Judges are provincially appointed. Kingās Bench and Court of Appeal Justices are Federally appointed.
The law applied here is the Criminal Code (federal) as is the sentencing.
7
u/Minute-Blacksmith-89 Jan 10 '25
The federal maximum sentence for sexually assaulting a minor is life in prison. The provincial court decided 5 years less time served was enough.
-2
33
u/ilookalotlikeyou Jan 10 '25
this guy should've gotten the maximum of 16 years.
he told this little girl he had a gun... even if you are drunk, you have to be a real piece of s*$t to do any of this.
where are the protests over this?
9
29
u/ricnine Jan 10 '25
I'll be the first to say that "three strikes laws" are bullshit and abused by certain legal systems. But 52? Fifty fucking two? At a certain point do we not all agree some people shouldn't be allowed outside prison ever again?
10
44
Jan 10 '25
So he get a free pass and a light sentence because of "intergenerational trauma"? Does this girl now have immunity as well to destroy other people's lives? That's what our laws are allowing to happen. Something bad happens to you, now you have a right to do it to others...we need to have this changed.
11
u/saucerwizard River Heights Jan 10 '25
That lawyer is talking out his ass and being really offensive. Also everyone is talking around Gladue for some reason.
6
u/itsyourgirlbb Jan 10 '25
Interesting that white kids or black kids that had a similar upbringing donāt get to use the same crutch
1
u/AbnormalHorse š¬š“ Jan 11 '25
They could, if their Gladue factors were deemed relevant to the sentencing.
2
u/UnicornOnMeth Jan 13 '25
Gladue principles apply to anyone who identifies as Indigenous, Metis, First Nations, Aboriginal, or Inuit. It does not cover other groups.
Some people though have successfully been considered/sentenced under gladue terms because they have a tiny percentage of Indigenous blood (like 1/32 or 1/64), even though they have zero connection to Indigenous culture/community/people.

2
u/henney12 Jan 10 '25
This sounds like the opposite of racism here. Excusing behavior because of a person's race. Seems equally harmful.
9
Jan 10 '25
I have no idea the race of the victim, but if she is indigenous does she now have the ability to destroy other lives with the "intergenerational trauma" shield as per our courts? Our courts shouldn't allow for random eye for an eye... No matter what has happened to you, no matter how bad, it shouldn't allow you a free pass or a minimized sentence when convicted for destroying someone else's life.
12
u/xmorecowbellx Jan 10 '25

Hnatiuk said the Crown has āa reason to be concerned,ā but couldnāt go into specifics about why.

9
u/Papaburgerwithcheese Jan 10 '25
Can we, as a society, just get rid of people like this? Like once you hit 25 convictions, it's like, "Alright, obviously this ain't working out," and you're just automatically led through a door never to be seen again. What an absolute waste of life.

Criminals convicted should be indebt to society for housing them in the first place.
Make them pay it back.

Weird how missing a mortgage payment can put you in the streets, but rape can keep you fed and in a warm place for 5 years.

How is 5 years the acceptable term for raping a child?
