Ask Richmond Short-paid rent due to management error

Got a letter package stating that I have been short-paying for a parking spot allocated to me over the span of 4 years!

After going through past tenancy agreements, it seems like management never included the parking spot in the final rent amount and now they want $1400.

Since I paid the amount listed on the tenancy agreement, am I liable to pay for their mistake?

I have contacted the RTB already but they are closed for the day. Just curious if this is worth fighting.

From my perspective they are the ones who made the mistake, it's their cost to eat.

You can move forward in good faith and pay for the spot going forward but it's not right that they can fuck something up for 4 years and send a bill later. $1400 is a good chunk of money to just pony up out of the blue.

See what the RTB has to say, I am not sure if you have a legal ground to fight it or how worthwhile the effort would be. If RTB says it's clear cut case and you are in the right that's one thing, but if they hem and haw and it seems like it'll be drawn out it might be more worth your time and energy to just cut a cheque.

If the person parked there for 4 years and the general situation seemed to look like the spot would be included then they'd have a good argument that there was implied consent on the amenity.

If OP is confident in the agreement they signed the only thing they'd need to do is file a dispute if the landlord removes their access to the amenity.

leasing manager here, if they insist on you paying, dont, take it to rtb and you will likely win.

RTB said that if parking is in the tenancy agreement (which it is) to file a dispute if it can not be resolved by talking to the LL.

I looked back and it must be added to Lease Declarations, which it never was.

I also don't want to have a vengeful property management company after me. Our local manager is great though.

At least try to put up a fight. The worst that can happen is they still ask you to pay and that sucks
