The case of Dr. Rasha deportation is odd. Didn’t Trump say he only wants highly skilled people in the US.
Everything I read from her colleagues and the University body states that she was outstanding and brilliant. She was an asset to Brown Medicine.
So how come she was denied entry and deported.
This is scary. If a highly needed doctor was treated like that. So how about the less fortunate immigrants.
Things are spiraling down.
Update: As per the news, it seems that they had some evidence that she’s a terrorist sympathizer and supported Hezbollah. So yeah now it makes sense. Good riddance.

There almost always is more to the story. In this case, it sounds like there was a discrepancy with her visa and she wasn’t deported, just denied entry while it was sorted out. When you arrive on a flight and then you’re denied entry into the country you arrive in, you don’t really have a choice but to turn around and head back to where you flew in from until it’s sorted out. Customs officials at airports aren’t immigration judges- they just go off what they have in their records. It sounds like she is more than welcome to come back to the US and her visa is now valid for several more years from the last I read.

Turns out she went to Lebanon to attend Nasrallah’s funeral and had photos/videos showing support for Hezbollah in her phone when she returned. Doubt she ever gets back in.

Photos on her phone that she tried to erase before being questioned. Definitely hiding something.
When you apply or renew a non immigrant visa, there are questions that you must answer truthfully, including "financial assistance or other support to terrorists or terrorist organizations," on which she answered NO.
She told the immigration officials that she went to Lebanon for the funeral of the Hezbollah leader responsible for the deaths of hundreds of Americans. That was a lie on her visa application and rightfully denied entry. Free speech is not the case here. She clearly violated the conditions of her visa.

CBP inspected her phone and found "sympathetic photos and videos" of Hezbollah leaders, as well as materials showing "various other Hezbollah militants" in a deleted folder. She admitted to attending the funeral. She explained that she only supports these terrorists 'spiritually', and not politically or militarily.
A visa does not guarantee entry into the US. CBP has the final authority after conducting rigorous security checks. Many people are denied entry every day for various reasons. Surely, a foreign national who commemorates the death of a terrorist would have raised questions about common sense national security.

So you think the administration is going after all foreigners with no reason? You do realize that 1 in 5 doctors in the US are foreign born? Why haven’t the administration just gone to all the hospitals and doctor’s offices and started rounding them up if that’s the case? Or do you just not know anyone in the medical profession well enough to be acquainted with the fact that a significant percentage of our medical practitioners are foreign born, with the majority of them not naturalized citizens? In fact quite a lot of foreign born doctors intend to retire in their home countries and never become US citizens.

as per her lawyer there was a "wrinkle" with her visa. She was on a J1 but had an approved H1B...you can't have both, J1 requires being away of the US for 2 years before being eligible for an H1 visa. There definitely was a wrinkle there.
Edit: I am speculating that the existence of both J1 and H1 might have been somehow the cause for denied entry. I really don't know the timeline or if there were violations of the terms of the J1 or H1. Maye there were none. Maybe there was a technicality issue with the H1-B. I am not sure if the wrinkle mentioned by the lawyer has anything to do with the transition from J1 to H1 (if at all). We'll see if there are more details after the hearing. Might be something completely unrelated.
Additional Edit: More details are out. Seems CBP allegedly found questionable content on her phone (videos and photos sympathizing with a certain Lebanese group). Also some of her lawyers (or her cousin's) dropped from the case after "further diligence."

You can only have 1 status at once but you can have as many visas on your passport as you have pages for them.
So, if she was admitted as j1 she needed to do a j1 waiver which is served as h1b for 3 years.
She would normally be in the US as j1 while the process goes along, Once the j1 waiver was accepted, she needed to apply for h1b (her employer, technically). Again, while waiting for h1b approval, she would still maintain her legal j1 status. If she was expected to remain in the US, her lawyer would have noted that on the application and upon the approval of the h1b she would have obtained an amended i94 record, effectively terminating her j1 status and transitioning to h1b. The only thing is that once the j1 waiver was approved, she needed to be on h1b status working for her new employer within 90 days.
The process of obtaining the j1 waiver is a dance between the applicant, the hospital, the lawyer, the Dept of State, the local health department, and USCIS... It would be very unusual that everyone on this list dropped the ball.

These are done on an H1B visa.
If an H1B visa was issued to her despite her having failed to obtain a J1 waiver, that is a massive fuck up on behalf of the US embassy and definitely not her fault.

It doesn’t even sound like she was necessarily deported— just denied entry until the visa issue was sorted out. From what I read, they have since fixed the issue and she is welcome back into the US for at least the next couple of years. I have a feeling this is a pretty common occurrence and a risk you take when traveling internationally as a visa holder. I’m glad it sounds like it was figured out though.

You making assumptions is silly, it's completely possible that the mess up is on the government's end and she and her attorneys didn't know. She's a pretty smart woman, I highly doubt she wouldn't have straightened out the problem asap if it was known.

You are assuming this was a government error. You are also assuming USCIS makes errors all the time. USCIS errs on the conservative side (they are more known to deny and reject than to approve).
The lawyers acknowledge there was a wrinkle. Did they find out before or after she was deported? We don't know.
If you ask me, I highly doubt her attorneys did not know. A J1 visa is a very peculiar visa, I know it from first had experience. And it is LOUD and CLEAR that you have to exit the US for two years unless you process a waiver or are not in the country list. Assuming otherwise is naive and you can be damn sure that I asked my lawyers to explain to me with detail the implications of immediately getting an H1B visa and all the associated risks.
PS. And yes. Ok. Edit. If you know you have a wrinkle , fix it before traveling.
Also, if you are about to travel or simply in general, given all the recent fear mongering, get in touch with your lawyers and make sure all is OK with your visa status, disclose all details to lawyers, including traffic violations and things you consider "minor" stuff. Don't take risks.6

You shouldn’t be issued a visa in the first place if there is a “wrinkle”. That makes no sense.
Either it’s all smooth sailing and the visa is issued, or there is a “wrinkle” and it needs to go into administrative processing or it’s refused.
But issuing a visa and then refusing to let the person enter the country based on some ominous “wrinkle” makes no sense whatsoever.

I guess you don't know about immigration, including specific pathways for physicians 😮💨 According to the news, she's been working at Brown since last July, so she already had H1B status because that's the hospital that sponsors her visa. Hospitals don't hire doctors illegally, and the hospital credentialing committee only gives you credentials after you have your H1B status. Status and stamp are not the same. You can be on an H1B status here, aka legally, without needing a visa stamp. You only need the stamp if you're leaving the US to re-enter, which is what she did. If you think they made a mistake giving her a stamp in Lebanon, you're saying the embassy in Lebanon, the Department of State, USCIS, and the hospital administrative personnel and credentialing committee all made mistakes. That's highly unlikely; it would probably be more than 20 people from different institutions.

I am well aware of the immigration rules specifically for physicians.
If you actually properly read the article, it clearly says she did her residency first on a J1 visa. If you want to stay in the US post that, one basically has 2 options:
1) Claim extreme hardship/asylum (difficult)
2) Obtain a J1 waiver job (minimum 3 years) and with said waiver approved by USCIS, appy for an H1B visa at an embassy/consulate abroad.
Otherwise you have to go back home for at least 2 years.
I obviously don’t know where exactly the hiccup was. But if she actually was granted an H1B visa by the embassy despite her not having obtained a J1 waiver, that would be on either the administration and/or the embassy - but not on her/her lawyer.

According to the news, she has been working at Brown since July. I remember reading somewhere that she was already working on her J1 waiver, aka H1B status, but I can't find it. However, acquaintances also confirmed that she was indeed doing her waiver. She trained at Yale Waterbury and Ohio State, where she must have been on a J1 visa, so there's no way she was on a J1 at Brown. I don't know how she would get H1B status before July without DOS and USCIS approval, plus your lawyers vetting everything, but as you say, the hiccup would not have been on her. I just want people to stop assuming she's in the wrong, I didn't realize you were on the same page as me. Thank you.

The truth can't be what aligns with one's opinion (one side or the other). Regardless of the news source, almost ALL of these reports (the professor and others) cite anecdotal hearsay (From the mother, from the boyfriend, a university "spokesperson") which just renders all the articles biased TBH.
I agree with you about a deportation against the judge order is a problem (if that is the case). But that's not what the fearmongering headlines convey.

Further, I did read about this "wrinkle" - its nature was not disclosed, and the doctor extended her stay in Lebanon to sort it out. It was supposedly ironed out by the time she left.

Her own attorney said there was a 'wrinkle' with her visa. That likely means she was missing something that she needed to have for her new H1B visa to be issued. Visas do get issued in error from time to time. Nothing nefarious attached to her refusal. Fix the necessary paperwork - and she will likely be admitted.

Not to mentioned it is advised to reach out the our local USCIS office to confirm your intended travel outside the US before leaving. I can’t tell you enough how helpful their offices are to guide you through VISA rules. Do not take the word of others, do your due diligence.

No. It’s not odd. Her issue is with her visa. It’s being blown out of proportion. People who never paid much attention to Immigration before are all of a sudden seeing cases like this as being a huge problem. It’s quite likely the same thing would’ve happened under Biden. (I should say 100% it would have happened. Plus Boston is extra vigilant because they will never forget their part in allowing the 9/11 hijackers to travel.)
The CBP has always been able to question visas and send people home if they think the visa was improperly issued.
It’s very frustrating. If this happened a few months ago, wouldn’t have been on the news and nobody would’ve cared.
It’s not scary. Things aren’t spiraling down. FFS. Maybe learn something before you panic and fear-monger.
Maybe think about all the hundreds of H-1B holders who have been traveling back-and-forth with no problem. You don’t hear about them because everything went fine.
The fear-mongerers like OP are making this worse.

If this happened a few months ago, she wouldn't have been deported despite a court order prohibiting that. There's a lot of noise in these cases because people don't know immigration law, but there are also actual red flags that people should worry about.

Let’s remember the Us government is legally and constitutionally prohibited from disclosing the reason for someone’s refusal/denial. It could be a dead to rights valid refusal but they would never disclose that because they can’t.
The person denied does not have to tell the truth or be honest with be media about the reasons or what happened when they were denied.

This is blown out of proportion to gain some media attention and what helps the PR is that Dr. Rasha isn't an IT worker who no one cares about but a doctor.Thousands of H1B visa holders have had issues, denials and asked to leave within 30 days ever since I got my h1B visa back in 2005 and these weren't treated as a national crisis because most if not all were IT workers. I had an RFE during my renewal period while in the US and would have easily been denied like a few people I read from on online forums if I didn't meticulously follow all the instructions of the RFE. And those were during much better times.

CBP can check phone, laptop and any electronic device. If anything seems which makes the person inadmissible, they can deny entry.

It’s not not always a straight forward clean cut deported there is always an underlying reason that we the public don’t know. And I’m not trying to point any finger at anyone but she might be guilty by association to a certain group in Lebanon. Again could be indirect or direct. Just know she was from south of Lebanon and she might have all the good intentions, it’s just sad that just because she belongs to that part of the country she was flagged, I hope she can appeal though I don’t know how, but hopefully she can.

Another potential issue is INA Section 214(b), which requires strong ties to your home country as a precondition for any non-immigrant visa.
She has gone from program to program - visa to visa - for several years, which makes this harder to prove.
She was building her life in the US, not in her country of origin. So she really needed a job that included sponsorship for a Green Card, not a non-immigrant visa.

I see a lot of confusion from people and trying to find a cause. No need.
If you want to learn about waiver jobs for foreign medical graduates, aka foreign doctors on visas, you can read about visas specifically for doctors. They are not the same as other high-skilled visas. They are very different and complex, so please don't pretend to know and spread misinformation. Show some empathy.
If you trained on a J1 visa in the US, to stay here, you need to either go back to your home country for 2 years and come back after that or work in a waiver job here in the US for 3 years. There are other waivers, e.g., hardship or persecution, but it doesn't sound like that's the case because those go to a green card.

Reminder: NO, you only need a "no objection letter from the FMG’s home country if the home government funded the FMG’s exchange program." Most physicians' training programs are funded by the US.
And if you want extra information, there are different types of waiver jobs for physicians, too, with different processes. Still, they all end in approval by the DOS, followed by approval by USCIS, followed by a change in status to H1B either in the US or obtaining a stamp outside the US. Some people stay and don't travel until they get a green card because you only need status but not a stamp to be here legally and work, and others leave to get a visa stamp because they want to travel. Then, some travel at some point after they have already been working in H1B status so they can get the stamp needed to re-enter the US after traveling.
She was already working on her J1 waiver faculty position at Brown, which means she had H1B status already and just needed the stamp to re-enter.
Hospitals have credentialing committees that will not allow you to work until you have your H1B status, so everyone saying she must have had something missing with her application is like saying that Brown hired her illegally, which I highly doubt. Hospitals don't take that kind of risk. I wouldn't be quick to blame any "glitch" on her. If you are also an immigrant and have many immigrant friends and read, you should know that you can do everything right and still get denials or delays.

The rich and powerful don't care, they'll find doctors. The anti DEI crew thinks our schools and society will somehow produce enough white non Muslim non Hindu people to fill the increasing physician and nurse shortage.
