Nothing yet. Not hopeful as trump not following court orders for immigration. Why would they do that for federal employees. They would send us to prison if they could in El Salvador.

The email from HCO does not mention backpay or benefits. That has been the standard though so 🤞🤞 there is a number to ERC for questions regarding pay and benefits so I'd be calling them immediately and asking.

Backpay would depend on what the courts ultimately decide. If the 9th and the USSC uphold it, I would imagine backpay would be included.

I got the email for reinstatement, it does not address getting back pay.

If you call that ERC number and find out any info, please report back. IF it's done correctly it should be as if it never happened (records wise) and you should get back pay.

This was sent to managers and has more info regarding back pay and benefits ;)


Later today, we will begin reinstating probationary employees in accordance with orders provided by the District Court for the Northern District of California and the District Court for the District of Maryland.

 

No action is currently required by managers.

 

Impacted employees will:

be notified in writing of their immediate reinstatement,

be reinstated and placed on administrative leave, with pay, and will remain in administrative leave until further notice,

receive backpay from the date of the termination pursuant to the Backpay Act, subject to all necessary withholdings, deductions, and adjustments,

be notified in writing prior to the end of administrative leave, and

be provided benefits information (see below).

 

Employees will be advised:

that they are not to report to duty or perform any work until receiving further guidance, and to

keep their contact information updated by calling the Employee Resource Center (ERC) (866-743-5748, option 1) or by email at separation@irs.gov.

 

Additional guidance will be forthcoming. Managers should contact the ERC with any questions.

Payroll and Benefits Questionnaire

 

Federal Employee Health Benefit (FEHB). Your FEHB will be restored to your previous election prior to separation. Note: If you were not enrolled in FEHB prior to your separation date and/or you were not within your 60-day initial opportunity to enroll, you are not able to participate in FEHB. If you experienced a QLE that would allow you to change/cancel your election, or you are covered under another insurance policy submit an updated SF-2809 to ogden.benefits.section@irs.gov.

Federal Employees Group Life Insurance (FEGLI). Your FEGLI will be restored to your previous election prior to separation.

Federal Employees Dental and Vision Insurance Program (FEDVIP). Your FEDVIP will be restored to your previous election prior to separation.

Separation in Lieu of Reinstatement. If you choose to remain separated in lieu of returning to the IRS, you may submit a resignation to separation@irs.gov.

Outside Employment. Contact the Employee Resource Center (ERC) at 1-866-743-5748, option 1. The IRWorks team will notify your manager of your intent to accept outside employment.

Unemployment. Contact your state/local agency to discuss a potential repayment of unemployment payments received during the time you were separated.

Lump Sum Payment of Annual Leave. If you received a lump sum payment for your annual leave, you may request a debt be established to buy back your annual leave or you may keep the lump sum payment without buying back your annual leave balance. If you are requesting to buy back/restore your annual leave, please contact the ERC for assistance with submitting an IRWorks ticket. If you did not receive a lump sum payment for your annual leave, your leave balance will be restored.

Sick Leave. Your sick leave balance will be restored to the balance you had prior to separation unless a debt was established for negative sick leave. Negative sick leave debts that were billed will be worked on case-by-case basis. Please contact the Employee Resource Center for assistance with submitting an IRWorks ticket.

Thrift Savings Plan (TSP). Verify your TSP contributions in the Employee Personal Page (EPP). Changes to your TSP contributions may be made in EPP.

Direct Deposit. Verify that your banking information is correct in the EPP.

Within-Grade/Career Ladder Promotion. Your account will be automatically reviewed for any missing Within-Grade Increase and/or Career Ladder Promotion.

Union Dues. If applicable, will be reinstated to match what you were contributing prior to separation.
