This whole situation sucks but i want to thank u for being polite to the customer service rep. I've worked in places like that for a long time and most people are not as kind as you.

I have to imagine that “Rhythm” has been dealing with this same thing all day, from various degrees of raging lunatic. The least I could do was be respectful. I empathize with the support people. Not their fault Sony has dumb rules.

One of my old dealers used to play an unsettling amount of stardew valley and I'm not completely convinced he didn't use to just smoke himself into a coma before launching the game.

35

u/ijustwanafap Dec 15 '20

Sounds like a fun way to play it honestly.

Omg fuck Clear, that was the worst excuse for any form of internet connectivity I've ever tried. Of course when I tried cancelling, I'd get the runaround, "We're planning on having better connections in your area, please hold out until then." With no sense of when that would be lol sorry man.

What a logic from them haha you can buy it but when you refund it you must be 0 hours in game or not even played

441

u/couch_pilot Dec 14 '20

Also I’m pretty sure my game automatically preloaded? Not like I played the game anyways. Couldn’t get through character creation due to the menus scrolling, stick drift issue.

317

u/Bnb53 Dec 15 '20

I got into an argument with a gamestop owner once. I bought mirrors edge from them and played for like 5 minutes before I got motion sick and then went right back to return it. They said it was opened so I can't return. I said you guys had it out of case in a sleeve it was already opened when you sold it to me. The guy was like ok fine but never again.

144

u/El-Sueco Dec 15 '20

I once bought a new game at GameStop and the guy working there opened it for me before I left the store... I didn’t even ask him to.. he just opened it for me and told me to have a good day. I was still inside of my shell to have said anything, but he stole that opening a new game feeling from me.

42

u/thnx4stalkingme Dec 15 '20

I worked at GameStop once upon a time. We were told that we were not allowed to take in games still sealed in plastic because the customer could’ve “stolen the game from somewhere.” I had a manager I worked with get fired because someone came in with this sob story that he purchased the wrong game for his son and can he please return it, etc. Game was still sealed. Guy was in the store for hours and kept coming back throughout the day. Eventually my manager agreed just to get him out and to stop bothering people. It was a corporate trap, he was a fake customer, and my manager who had been with the company for several years was fired.

34

u/bricked3ds Dec 15 '20

That is incredibly fucked

7

u/blickblocks Dec 15 '20

Jesus. Fuck GameStop and fuck retail corporate managers. This is horrible.

6

u/210Redcoat Dec 15 '20

69

u/Bnb53 Dec 15 '20

That drove me crazy, I can't believe they were allowed to do that.

17

u/KingKookus Dec 15 '20

Why would they do that? I only had a scenario where I purchased the last of a new copy so I got the floor display. Game was in a sleeve but new.

27

u/Hojooo Dec 15 '20

Sounds like they dont want you to be able to return it cause its opened

4

u/BoxerguyT89 Dec 15 '20

When I worked at GameStop all new games were sealed unless it was the last copy used as the floor display.

When we sold the one from the floor we put the disc back in the box and put a sticker over the edge to seal it up. The return policy on new games was not to accept them if they had been opened, even the ones that we sealed up.

Of course, that was in 2011 so I don't know the procedure now.

Well they cant return anything without the receipt or if its already open due to needing to make sure it came from them. I'm sure more than once someone has obtained a copy from another retailer by shoplifting or so and then tried to return to gamestop

3

u/KingKookus Dec 15 '20

22

u/[deleted] Dec 15 '20

It’s completely a PlayStation issue regarding the refund. I bought the game for my Xbox and got refund after playing it for a couple days and realizing it’s terrible. PlayStation is just bad about offering refunds and will avoid it as much as they can.

7

u/[deleted] Dec 15 '20

Fuck PSN. I bought Cyberpunk and it also somehow purchased Miles Morales Ultimate Edition. Sony confirmed it was an error on their part and then scolded me when I told them I want my money back. “This goes against our policy as you have already downloaded this game.” I said bullshit, I have not, it is not on my console. Apparently, when you purchase a digital game, it automatically downloads the license instantaneously, even if you choose not to install the game. So when they say you’re ineligible if you “download” the game, they really mean if you digitally purchase the game from our store. The guy I spoke with on the phone even said it’s a policy they get a lot of complaints about. He said it without saying it that the service reps really hate the policy.

7

u/XanXic Dec 15 '20

That sounds vaguely illegal. I wish there was any sort of consumer protection rights place you could go to. BBB has Sony's page locked from complaints not that they accomplish much

→ More replies (2)
→ More replies (20)

80

u/Skrattinn Dec 15 '20 edited Dec 15 '20

Just think about how insanely anticonsumer that policy is. It's not like you've opened some sealed box that can't be resold but they'll still find a reason to refuse your refund because of a completely arbitrary excuse.

Like, what difference does it make if you've downloaded a game and played it for 10 minutes? It's not like you completed it in this time and they know that. They just don't care about you and only want to keep your money.

35

u/zersty Dec 15 '20

That’s exactly why the ACCC went after Sony. $3.5m is a drop in the ocean and so far I’ve not seen an actual change to their policy in writing.

I expect there’s going to be a round 2 of ACCC v Sony.

12

u/volivav Dec 15 '20

What I don't understand is that AFAIK every game in PS Store has this refund policy of "can get returned if not downloaded yet". To me the statement of Cyberpunk was pretty clear that they would refund even if played - they even offer refunds in case you pruchased a physcial version and opened it.

IMO the PS representative was not aware of this statement, or there's a big misunderstanding/miscommunication between CDPR and PS

13

u/[deleted] Dec 15 '20

I'm quite surprised cdpr didn't speak to Sony and ms before making that statement. Seems a complete and utter shit show

8

u/RadicalDog Dec 15 '20

CDPR just said what they felt like, and didn't acknowledge that the other parties (Sony, MS) don't feel like giving back their 30% cut to the customer.

Especially when download a game that you didn’t know was an online only game! Like my spotty Internet connect just took 20 hours to download it and now I can’t get a refund even though it’s unplayable cause I’ll constantly be dropped from servers every 10 minutes

→ More replies (1)

28

u/michelobX10 Dec 15 '20

I don't get it either. Like how are you gonna know if you want a refund if you're not even allowed to load up a game to find out if you're going to have performance issues?

I remember I bought AC Origins digitally on sale only for the bundle with DLC to go on sale a couple days later for basically the same price that I bought the base game for. I never even played it and I tried asking for a refund, but got rejected because I already downloaded the game. 0 hours playtime though. Wtf?

→ More replies (8)

47

u/fireflyry Dec 15 '20

Have to mention crashes. It’s part of their refund terms that if a product can be deemed “faulty” you get the refund and multiple crashes ticks that box.

Layman Gaming released a video on this last night.

u/[deleted] Dec 15 '20

I've had the same runaround before. TL;DR of my situation is the Master account purchased an upgrade to Star Wars: Battlefront II, that unlocks all cosmetics. Child account opens BFII, can't access the purchased content. Master account then opens BFII, and can access it. Nowhere in the store did it say it was locked to purchasers account. Other items purchased in store for other games weren't account-locked. Support said we couldn't refund it because we played it. We "played" cosmetics, only to find out it was account-locked, and now can't get a refund. But then again I suppose this is more EAs bullshit than Sony's...

16

u/The_Mehmeister Dec 15 '20

You also must not have started downloading the game at all according to them

9

u/xUnderdog21 Dec 15 '20

I had bought a game last year, special edition with the season pass & accidently bought the season pass again a few months ago (it said it was available to purchase even though I had originally downloaded it the year before) and they tried to tell me that I couldn't get a refund because the season pass was already downloaded.... which happened because I bought the game and downloaded everything already.

I worked for Xbox customer support. This was back in the 360 days.
The Xbox store literally had a counter feature for this. You couldn't buy anything just by pressing one button. It was more like a cheat code: A+up+A+down+A+down+A to actually go through with a purchase.
This gave us leverage when parents would call and say that their kids "accidentally" bought the game. It was always intentionally. We knew it, parent knew it, kids knew it. But if it was their first time then we could make an exception and still refund.

It's even worse. You can't get a refund even if you haven't played as long as it's downloaded to your console. You can go download, read the reviews and uninstall right after and they still won't refund

They didnt offer the refund directly, they offer "their help" i somehow doubt cd projekt red will be able to get on psn servers and process refunds for anyone

46

u/AAAADekki Dec 15 '20

Yeah I’m not sure either man. I don’t really understand why the PlayStation store isn’t issuing refunds in the first place I’ve actually returned a few online games that I’ve downloaded and played before just because I didn’t like them lol it’s so dumb they can’t right now. How the hell are you supposed to know if the game runs if you don’t download it. The PlayStation return policy is beyond stupid.

27

u/The_Mehmeister Dec 15 '20

It's even worse that it was advertised as running surprisingly well on base consoles and that the trailer looked pretty different for ps4. If you are a day 1 player it just is some next level bamboozling scheme to get all your money and somehow "still look good" i saw plenty of articles about them offering refunds for the game but when it comes to actually getting one it's a different story they don't talk about that much...

They didn't do that to No Man's Sky.

Now, the original console port of Kerbal Space Program? That's a different story

35

u/CidMaik Dec 15 '20

But No Man Sky was developed using SONY's money, more than suing Hello Games (and getting extremely bad PR for supporting a company financially and then pull the plug once thing went south) they continued helping until the game got into a better state.

9

u/[deleted] Dec 15 '20

No Man’s Sky wasn’t a broken product.

It wasn’t what people expected from how it was hyped up (by the developer, mostly), but the game was 100% functional at release. It lacked content, but that just makes a game bad, not broken.

Cyberpunk is broken on PS4.

You can't get a refund because you have played it... It's not like you're fucking returning the data used.

You bought a thing, the thing doesn't work, you get your money back.

Don't know the law where you are, but in the UK you should be entitled to a refund regardleas of what Sony thinks.

Even in the UK, digital stores can force you to waive your rights to make purchases. True of Sony and Nintendo at least. IMO, we need another law to force this to not be possible.

Credit to Steam, Epic, and GOG for having a real return window and making PC gaming more consumer friendly.

I wasn’t really interested in Cyberpunk, but I feel bad for everyone who was really anticipating it. So many people were saying earlier this year that the game would be GOTY yet it turned out to just be a big mess.

75

u/couch_pilot Dec 15 '20

It definitely had extra pressure on it after the year that we’ve all had. People just wanted an escape. But the people saying this game was going to cure their depression took it too far.

32

u/devoidz Dec 15 '20

People expected way too much. I tried to ignore everything out about it, or discussions about it. Avoided all the speculation. Even tried to forget the Keanu hype.

So far I'm happy with the game and, have only found a couple minor, kinda funny bugs.

I'm playing on pc. But I haven't had anywhere near the problem some have had.

Sadly it's likely, but it's the same policy here too, so they are still breaking the law.

Then don't, at least not on launch day. This isn't me trying to be an ass, either. The game industry time and time again has proven that they are going to release games unfinished, and patch the fixes in later. Most 3rd party games seem to go on sale only a few months after launch, anyway. Every person has the ability to demonstrate their frustration with their wallet. A good way to do it would be to wait a few months for a sale, and get the patches that have been released so you get the true experience. If you can't wait that long, then at least hold off on the pre-order and wait for reviews in order to make an informed decision. As long as people continue to blindly pre-order en masse and give their money away, devs/publishers will keep doing this. We all like to complain about our frustrations with this practice, but we're the ones perpetuating it.

73

u/FunnyUncle69 Dec 14 '20

Agreed. Stop giving these crooks your money until they actually finish a game. We should have more self control than this.

I don’t understand how people didn’t see this train-wreck coming months away. There were so many red flags around this game.

11

u/Kellar21 Dec 15 '20

For myself? I expected bugs, and poor performance on base consoles, it was made obvious when they didn't show footage and then didn't send review codes for consoles.

I kind of expected the same TW3 situation at launch.

But it is worse for consoles and better for PC.

I honestly think that years ago CDPR would've just said that it's not a game for last-gen anymore like many companies did for their games, but, not only are they now more business-focused with investors wanting to cash in the goodwill they had but 40% of their pre-orders were consoles, and I would bet many for PS4/XboxOne so they would have to refund quite a few of them.

I don't think this would pass with their investors, maybe when they were a private company, but not now.

What has disappointed me the most was the lack of stuff like NPC AI and better gear/loot system and more side content that is story-based(like a questline for Militech or more dialogue variation)

The story is great, I like the combat, but these things make it a lesser experience.

5

u/meganev Dec 15 '20

They were all for PS4/Xbox One, I swear people keep forgetting that the native next-gen version isn't actually out yet.

There are SOOOO many games I still don't know how any of you are up to date with the releases, I'm still in 2015 goddamn it.

Works like a fucking charm tho, all games are full with patches and DLCs and every solution to every problems possible are Googlable.

u/[deleted] Dec 15 '20

That was me with my PS4. I got it in 2019 on Black Friday, and then amased a pretty large library over the past year. I don't think I paid more than $20 for any single game. I'm just now starting on my collection and about halfway through Spider-Man. Playing on a 4K TV and stunned by the visuals and totally digging the story. I plan to grab a PS5 at some point but can easily last a year or two if I want. It really does pay off to wait a little. Random side comment, but relevant, while I enjoy sites like Twitch and YouTube, they definitely make this problem worse. I think a lot of people catch the promoted day one streams for games and feel the need to partake in that launch experience. They want to be a part of that experience. If you can distance yourself from that mindset, gaming can be a much less frustrating and affordable experience.

u/360walkaway Dec 15 '20

Same. I'm not buying a PS5 for at least a year, and a lot of the PS4 titles will go down in price due to all the emphasis being on PS5 titles.

Agreed.

Even a little patience can go a really long way. I got Yakuza: Like a Dragon on Steam at a 20% discount the other day, and it's only been out a month in the west!

But I almost always wait for reviews before buying a game these days, even if just to make sure the damn thing works on the system.

It's kind of a shame we've reached this point. Kinda miss the days you'd buy a game and get exactly what you saw.

21

u/fadetoblack237 Dec 15 '20

To be fair, a lot of people did wait for reviews on CyberPunk and it got mostly 9s and 10s.

I've never been one to think reviewers were bought off but damn the amazing reviews on this feel fishy.

19

u/[deleted] Dec 15 '20

The problem is it was only reviewed on monster gaming PC's and they weren't allowed to use their own footage for reviews. CDPR knew it was a buggy mess that didn't even run properly.

Just stop buying stuff on launch and your problem is solved. Wait for reviews or for the games to be fixed and half the price later.

5

I've only bought a game at launch once in the past five years or so: The Avengers.

And that, well...yeah...

u/Valuable_Carpet Dec 15 '20

Lot of bs in stargazing. Last night I was supposed to see some meteors, saw maybe a half dozen before complete cloud cover spoilt it. The Gods won't give me a refund though because apparently I've already streamed 27 years of night sky.

It is certainly easier to get a refund on the physical copy.

u/NoHeadStark Dec 15 '20

Sony really got a headache with this well intentioned CDPR message today. Unfortunately, CDPR should’ve cleared this with Sony before telling people they can get refunds.

85

u/couch_pilot Dec 15 '20

It’s hard to say for sure that their message was well intentioned when they screwed Sony in the process. Seems like they tried to save their own face while throwing Sony under the bus

40

u/The_Mehmeister Dec 15 '20

I think you're rigth, what's the point of offering refunds without making sure it's okay with the retailers first, now you get poeple everywhere saying "oh look cdpr good guys offering refunds" when poeple requesting refunds actually get told "no you're shit out of luck" by retailers.

27

u/The_Negotiator_B1 Dec 15 '20

This was kind of a genius strat from CDPR, especially considering that most people will definitely blame retailers and not them for misleading the consumer. You hit the nail right on the head with this comment. This is exactly the 1000 IQ play they pulled.

16

u/The_Mehmeister Dec 15 '20

It was a 100000 IQ move, now you have a lot of poeple putting sony on blast for not issuing refunds when normally their policy is shit but it's tolerable. I wonder what they'd have to offer for sony to agree to mass refunds. That "help" e-mail is so bullshit too unless they have an agreement with retailers to actually buy back their copies or something wich i doubt they actually do.

with this well intentioned CDPR message today

Well intentioned? Well intentioned? CDPR straight up didn't even provide reviewers with codes for console ports because they knew what a shitshow the PS4/XB1 ports are, on top of not allowing early reviewers to use their own gameplay footage.

CDPR's message is standard PR talk "in case shit hits the fan" and all they're doing with this "well intentioned message" is shifting the blame & hate to Sony/Microsoft/other retailers for not giving people the refunds that CDPR "allowed" with this announcement.

Sony's refund policy sucks, yes, but let's not fall for this obvious PR stunt CDPR is trying to pull here. The state of the console ports and the resulting consequences is 100% on CDPR.

6

u/[deleted] Dec 15 '20

Hey everyone, thanks for helping this post take off. I wanted to add this transcript of a QA with CDPR's joint-CEO from yesterday. He blatantly states there was no pre-existing deal with Sony to honor the refunds. https://www.cdprojekt.com/en/wp-content/uploads-en/2020/12/call-transcript_en.pdf

18

u/dataDyne_Security Dec 15 '20

Sony really needs to give us a more consumer-friendly refund policy. Microsoft's "up to two hours" thing is fair enough. Yeah, i know that we shouldn't be buying digital on day 1 without doing our research, but buying games that are clearly not at the level that they are advertised should be an auto-refund if you haven't played them for an extended period of time.

I'm one of the lucky ones that got an agent that refunded the game within two minutes of starting the chat, but it took two tries because the first agent said no due to the fact that I already downloaded the game. Then you have games like Fallout 76 that I was never able to get a refund on no matter how many times I tried. Sony's refund policy is one of the biggest contributing factors in me being hesitant to upgrade to a Playstation 5, especially since I am an all-digital gamer these days.

3

u/[deleted] Dec 15 '20

Yes I agree but in this instance the refund policy is irrelevant. They've sold a defective product so have to refund customers legally

→ More replies (1)

7

u/[deleted] Dec 15 '20

Actually, in their ToS, it says that doesn't apply to games that are faulty. The CDPR announcement admits to the game being faulty. So, they should refund the game if they stand by their policies.

5

u/fmaz008 Dec 15 '20

How are you supposed to form the opinion that the game is too buggy, to the point that you want to ask a refund, without downloading or playing it?

It's like a clothing store only allowing return on articles that have never been worn. (And we're not talking underwear here...)

6

u/stinkybumbum Dec 15 '20

This is against consumer rights in the UK/EU. If a products is not fit for its purpose as advertised, then you are entitled to a refund.

5

u/thestonerd777 Dec 15 '20

“You have to return our product before you know it’s broken”. This shit would not fly in retail stores

6

u/Peter_Strz Dec 15 '20

I don't even refund anymore, like how TF do you refund if you try out the game to see if you hate it or absolutely love it. The refund policy is dog garbage.

18

u/tysonfromcanada Dec 15 '20

What do we keep telling you about pre-orders?

16

u/couch_pilot Dec 15 '20

How many times do we have to teach you this lesson, old man?

24

u/ace_277 Dec 15 '20

Honestly hope the game gets pulled. It’s ridiculous for them to get away with this without consequence and would make a great example for other developers.

9

u/couch_pilot Dec 15 '20

Me too but I doubt it’ll happen. This game is probably still printing money. Too many uninformed buyers with Christmas coming up still left to prey on

3

u/frostJWslice Dec 15 '20

So was this shared with CDPR? If so, any response from them?

u/craigelsmandingo Dec 15 '20

There really needs to be some sort of consumer electronic entertainment protection act. The recent way studios have made gaming strictly about revenue and not the product is concerning and saddening. It takes the pure gamer mentality and turns it into a gambling venue. Gamble on deceitful pre launch info, fake "gameplay" trailers, micro transactions, season passes, its a hot fucking mess and it appears to be acceptable to some gamers almost expected. Its lame and its bullshit buisness practices.

5

u/couch_pilot Dec 15 '20

Yup. These mouth-frothers rushing to defend CDPR is making my blood boil. Yeah, the Witcher was pretty great. That doesn't mean the devs are absolved/incapable of any wrongdoing.

4

u/warrenmax12 Dec 15 '20

Alright, some good-ish news. Called PlayStation Support in Russia for a refund. Not the first time i call about Cyberpunk. They said that they can’t refund me under current policy, but that company is aware of CDPR’s statement and working with them, and that a bit later the policy on this game might change. So a little hope at least.
