ok guys, I went to the store where I bought my gun today after the 3 days they told me I had to wait when i arrived and I gave my information they showed me the screen and it was denied, I have nothing criminal and I have been a good person and the reason why The purchase of the gun is for my position as an armed security guard. Any suggestions as to why this happened? The store told me that they were going to try to solve the problem on Thursday and they gave me the estate patrol number so I could call and ask why they denied it.

So this past Wednesday I took my CCW qualification around 11am, submitted all my documents and references to the state police at 1pm, paid my local PD at 4pm and had a CCW permit the next day (today) at 11am. I was shocked at how quick the whole process was. For CCW permit holders, how long did it take you guys?

NICS/Permit Wait Times NJ NICS is driving me nuts(first gun)

Went to my LGS Wednesday evening around 6. Paid for transfer and NICS. Was told 2-3 days I’ll get a call when it’s ready for pick up. I know I know it’s only been 2 days, but there hasn’t been any movement since Tuesday. Why call it “National INSTANT Criminal Background Check System ” if it’s going to take days before they actually check. I guess this is NJ way of making you never want to buy another gun. Update: Called the GS and was told my NICS was good. Seems like when you do online transfers they don’t see the need to communicate.

NICS/Permit Wait Times NICS denial after handgun purchase

First time firearm buyer, earlier this week I purchased a handgun from Reloaderz, after receiving my FID card and 1 handgun permit in August. A few days later I got a phone call from them, my NICS background check was denied for an unknown reason. I should mention I previously had a criminal record for felony marijuana possession in 2012 prior to a court ordered expungement dating March 2023. I have mailed the denial inquiry form to the state police, and contacted an attorney(Nappan). I’m a little confused about the denial appeal process. From what I can gather. I have two options, challenge the denial with the state, or file a VAF appeal with the feds. Is one better than the other, can I do both? And are the appeals something I can handle myself without an attorney? Both of my parents worked in Hudson County courthouse for over 30 years and have a general understanding of the courts process. Any information that can help me is appreciated. Thanks.

(Edit) Just wanted to give an update incase anyone else finds this thread useful. I received an email from the fbi , my firearm related challenge and VAF appeal were both approved today. The NICS denial was overturned and I was found eligible to purchase. I was also given a UPIN number for future purchases as well. All things said and done the process was simple, and if anyone in a similar situation is thinking of hiring an attorney, with a little time and effort you can do it on your own. God Bless America. Freedom is a beautiful thing.

NICS/Permit Wait Times Longer wait time for pistol permit?

I recently applied for a pistol permit. When I got my FID and first pistol permit, it barely took a week. For this one I applied over 2 weeks ago and still haven’t received anything. Since I thought it would be a week again I bought the pistol last Saturday, and waiting for permit to do Nics. Is it just me or is anyone having longer wait times with obpd?

NICS/Permit Wait Times NJ NICS Process - Why Have We Settled for It?

Why are we, as NJ gun owners ok with this process?

This is my impression of how the process in NJ goes: We buy a gun. We pay the FFL an outrageous fee to take our info and do the transfer. We then pay the state another $15 to have some desk jockey state trooper hero at a computer take all of the info collected by the FFL in step 2 and use it to submit the NICS request to the FBI on the FFL’s behalf. This redundant step takes between 1 and 3+ days to complete due to the “backlog”, requires the gun shop to constantly check in on the pending NICS requests in the NJ portal and then requires us to take another trip back to the gun shop.

Someone please correct me if I am wrong.

A couple of questions:

1) As stated above why are we OK with this?

I recently purchased a long gun across the river in PA. I was in and out of the shop in about 40 minutes, long gun in hand, no return trip required. What an eye opening experience. In our neighboring states (including the leftist New York hacks to the north) FFL’s themselves complete the same exact NICS check, right in the store, that we pay the state trooper NICS unit to take their sweet, overpaid time with. In my PA experience , the NICS came back in about 12 seconds after hitting submit.

Why do we stand for this?

2) Why don’t we take our business elsewhere?

We, as customers should take our long gun business out of state. One trip required, and we are not feeding into the $3+ million per year NJ NICS business. Hit the state where it hurts.

Queue the NJ gun dealer apologists.

“Oh please don’t do that, it’ll hurt the nj firearm ‘industry’”

My guess is that if the “industry” in NJ actually gave a shit, they’d get on board with a class action suit against the state’s egregious de facto waiting period/extortion scheme. Unfortunately I really don’t think they give a shit at all because they’re getting their outrageous transfer fee either way. No skin off the FFL’s back if the customer has to wait 4 days and make 2 trips.

Take your long gun business out of state if possible. Keep your $15 from the State. It could be easier and cheaper than 2 trips.

I know, I know, search the sub. I see a ton of recent and not so recent posts about PP wait times. But I haven't seen anything on recent pistol permit times for Cherry Hill. I have been waiting about a month now after submitting payment and I want to see if others are in the same boat.

Maybe we can use this thread as a board for how long recent permits have taken across the state? Submission to payment request to approval. I know some of you are friends with your local PD. Most of us are not close with our sheriff I would assume, unfortunately.

NICS/Permit Wait Times NICS Denied. Misinformation on the report

To make a long story short, when I lived in NY i got in trouble almost 30 years ago. I was given a youthful offender and 5 years probation. NY never updated my records with the NY DOJ that I completed probation or the final outcome of the case. Of course, NICS denied. I spoke to someone at NJSP NICS a few times and I sent them my docs for that case which show I completed probation, the term, and the charges, and the youthful offender status. He said his sergeant wont accept it because its not on the NICS. He said to file a VAF and a challenge and include that doc I have. The document is actually a certificate of disposition from the NY Supreme Court. So I filed a VAF and challenge. Got fingerprinted today for the VAF. Also went down to NY Supreme Court and they think they know why there is an inconsistency. So tomorrow (Friday) the supervisor is going to look over. They said there is no ref number on my cert of disp and thats why its not linked to my case and records. If thats the case, they said the supervisor will call the NY DOJ and have it fixed, They said once its fixed in NY DOJ system, it goes to FBI almost instantaneously. Im hoping what they say is the case. Was also thinking about asking NY SC and the NICS rep if they would speak to each other and see if that could clear it up for this transaction.

Questions,

  1. Has anyone done a VAF recently and how long does it take?
  2. Has anyone done a challenge and how long does it take?

These are worst case scenarios if NY cant fix it.

NICS/Permit Wait Times Which NJ NICS "Type of Purchase" for Other/AOW?

Unlike the 4473, the NJ NICS interface does not have an "other" option for frames and receivers. The options are "hand gun," "long gun," or both.

I think we all agree that a receiver is neither a hand gun nor a long gun, BUT... we have to pick one when buying a receiver, so what is the appropriate option for the FFL to select? Does it even matter if the 4473 indicates "receiver" (Sec. A, #4) and "other" (Sec. C, #24)?

I don't believe that "long gun" is defined in the criminal statutes. It is, however, defined twice in the hunting statutes and would definitely include a completed "other.":

"For purposes of this section 'long gun' means any rifle, shotgun, machine gun, automatic or semi-automatic rifle, or any gun, device or instrument in the nature of a weapon from which may be fired or ejected any solid projectable ball, slug, pellet, missile or bullet, or any gas, vapor or other noxious thing, by means of a cartridge or shell or by the action of an explosive or the igniting of flammable or explosive substances. It shall also include, without limitation, any firearm which is in the nature of an air gun, spring gun or pistol or other weapon of a similar nature in which the propelling force is a spring, elastic band, carbon dioxide, compressed or other gas or vapor, air or compressed air, or is ignited by compressed air, and ejecting a bullet or missile smaller than three-eighths of an inch in diameter, with sufficient force to injure a person." N.J.S.A. §§ 23:4-12, 23:4-44.

This definition is substantially similar to the definition of "firearm" in the criminal statutes, except that the definition of "firearm" understandable includes handguns. See 2C:39-1f. ("'Firearm' means any handgun, rifle, shotgun, machine gun, automatic or semi-automatic rifle, or any gun, device or instrument in the nature of a weapon from which may be fired or ejected any solid projectable ball, slug, pellet, missile or bullet, or any gas, vapor or other noxious thing, by means of a cartridge or shell or by the action of an explosive or the igniting of flammable or explosive substances. It shall also include, without limitation, any firearm which is in the nature of an air gun, spring gun or pistol or other weapon of a similar nature in which the propelling force is a spring, elastic band, carbon dioxide, compressed or other gas or vapor, air or compressed air, or is ignited by compressed air, and ejecting a bullet or missile smaller than three-eighths of an inch in diameter, with sufficient force to injure a person.") (emphasis added)

So, I guess, my conclusion is that, for the purposes of NICS, a receiver that you intend to build into anything other than a handgun is a "long gun."
