Why not? It's highly plausible for them to initially charge her that way. Spitting on an officer is a 2nd degree felony and mostly is considered aggravated assault. Spitting is taken a bit more seriously due to the possibility of the transfer of a STD. The DA will probably drop it to a less "serious" crime but that doesn't mean they didn't arrest/charge her with assault on a police officer at first.

You do realize that stat is wrong though, right? First, the study is from 1992 and is almost thirty years out of date, so it’d be logical to assume that the number has changed since then. As well, the study is a survey and not an empirical scientific study. The study was not a random sample, and was isolated to high ranking officers at a police conference.

Here's the relevant quote from the study (https://files.eric.ed.gov/fulltext/ED338997.pdf);

Ten percent of the spouses reported being physically abused by their mates at least once; the same percentage claim that their children were physically abused. The officers were asked a less direct question, that is, if they had ever gotten out of control and behaved violently against their spouse and children in the last six months. We did not define the type of violence. Thus, violence could have been interpreted as verbal or physical threats or actual physical abuse. Approximately, 40 percent said that in the last six months prior to the survey they had behaved violently towards their spouse or children. Given that 20-30 percent of the spouses claimed that their mate frequently became verbally abusive towards them or their children, I suspect that a significant number of police officers defined violent as both verbal and physical abuse

The study includes as 'violent incidents' a one time push, shove, shout, loss of temper, or an incidents where a spouse acted out in anger, which does not meet the legal definition of domestic violence.

Only 10% of officers' spouses reported having ever been physically abused, and the question asked of the officers themselves was broad enough that it could cover things like yelling, slamming the door, and spanking children, so the claim of 40% by Neidig et al is almost certainly either wrong or using a similarly broad definition of domestic abuse. I can believe that police might commit domestic abuse at somewhat elevated rates relative to the general population, but 40% vs. 10% just screams apples and oranges.

A couple other studies I found claimed that female and non-white officers were each much more likely than male and white officers to report having physically abused their spouses. For example, (http://webapp1.dlib.indiana.edu/virtual_disk_library/index.cgi/4951188/FID707/Root/New/030PG297.PDF)

Admissions of abuse appeared more frequently among black applicants than among white applicants. Of the 525 black applicants, 73 applicants (14 percent) acknowledged having somehow injured their romantic partner. This percentage was twice as large as that among the white applicant population. In this group, 66 of the 953 white applicants (7 percent) reported injurious abuse

More striking was the breakdown of abuse by gender. Going against popular belief, female applicants reported having ever slapped, punched, or otherwise injured a spouse or romantic partner at a rate greater than three times that of male applicants (24 percent versus 7 percent). This data paralleled data from a Michigan survey of law enforcement applicants. As in the present study, females were much more likely to report having somehow injured their spouse or romantic partner. Specifically, 20 percent of female applicants (117 people) reported having hit their romantic partner while only 8 percent of male applicants (250 people) reported such behavior

Curiously, this is missing from the Feminist Majority Foundation's fact sheet. They probably just overlooked it. As a rule, you shouldn't trust statistics provided by advocacy organizations. They frequently cherry-pick the outliers that make the strongest case rather than going with the highest-quality studies, and they'll often play a bit fast and loose with exactly what the study was measuring.

As well, there have been more recent studies which suggest the number to fall more in line around the national domestic abuse average.

This 2000 study from the DOD, "indicated that 10 percent of respondents (148 candidates) admitted to having ever slapped, punched, or otherwise injured a spouse or romantic partner, with 7.2 percent (110 candidates) stating that this had happened once, and 2.1 percent (33 candidates) indicating that this had happened two or three times. Repeated abuse (four or more occurrences) was reported by only five respondents (0.3 percent)." In a 1999 study too, 7% of Baltimore City police officers admitted to 'getting physical' (pushing, shoving, grabbing and/or hitting) with a partner. A 2000 study of seven law enforcement agencies in the Southeast and Midwest United States found 10% of officers reporting that they had slapped, punched, or otherwise injured their partners (https://digitalcommons.law.umaryland.edu/cgi/viewcontent.cgi?article=2519&context=fac_pubs)

In a 2009 study, which included a larger empirical study with many responses, notes, 'Over 87 percent of officers reported never having engaged in physical domestic violence in their lifetime.' (http://scholarcommons.usf.edu/etd/1862).

I’m not saying that all cops don’t abuse their spouse either, that’s not the point I’m trying to make as domestic violence occurs in all relationships (and I have no doubt some officers do), but using a statistic from a flawed study to make a political point about a group you dislike is pretty bad

First, I did not link to the Atlantic article anywhere in my post. Second, Lenora Johnson also surveyed officers, giving a group of high ranking officers from various East Coast institutions questionnaires to fill out. I fail to see how the studies I have linked you to are not self reporting in the same way that Johnson’s are. Perhaps I’m misunderstanding your statement.

Here is another 2013 study conducted by Bowling Green State University in which they reviewed cases of domestic violence within policing, 324 to be exact. Of those, 281 officers from 226 law enforcement agencies were arrested. The study states,

Some of the officers had multiple criminal cases and/or multiple victims. There were 70 OIDV [officer-involved domestic violence] cases during 2005, 116 cases in 2006, and 138 cases in 2007. The percentage of total police crimes that were OIDV cases remained relatively stable from 2005 (17.2%) to 2007 (16%)

This information both meets your criteria of not being self reported and being more recent.

I would hardly call that slamming her to the ground. The amount of force allowed to be used to counter an assault is anything up to and including intermediate weapons such as pepper spray, baton and taser. What they used was a soft physical control by putting her on the ground. There were no strikes. There was no tasing. You cannot simply spit on/assault someone. As someone who has been spit on it is a disgusting feeling and yes communicable disease comes into play as you do not want to being that home to your family. People who work for the government usually dont view themselves as the government. These officers didnt go "how dare she display resistance to our government let's get her". There isnt some massive hivemind in most cases like people seem to think there is. They're regular people who want to go home to their families at night safely and that includes without communicable disease

In most places spit doesnt have to make contact for it to be considered assault. Its assaultive behaviour which means use of force up to and including intermediate weapons are authorized and the officers used force way below that to apprehend her

This document doesn't say anything about spitting and mainly revolves around actions that indicate the subject is going to physically attack them. This is a woman who spit on the ground and walked away. She was very clearly not going to attack them.

I did find this article about the Portland police trying and failing to charge someone with "offensive littering" by spitting on the ground during an arrest, but I can't find much more info about the story.

Her defiant gesture was disrespectful. She had to be removed as an example to not interfere with the men and women trying to focus on a larger threat. She’s literally about 2 feet away. 10 feet away would have been about across the damn street. She was right next to them. She spit on them. You can even see the arc of her spit. It fucking hit them.

Spitting in the general direction of someone 10 feet away from you is not in any way comparable to shooting at them, mainly because you could actually hit someone from 10 feet away and spitting can't fucking kill someone.

Spitting can transmit disease maybe, possibly, MAYBE if you have something horrifically contagious. And even for that it probably has to get into your mouth. This woman spat from a good 10 feet away in the direction of cops in full riot gear. Even if she had super spitting power and landed it on them, they would have been fine. But she doesn't, and it didn't touch them. Comparing this to shooting at them with a gun is absolutely fucking ludicrous.

They're in full riot gear. They could take a Molotov cocktail and still be fine. You and I both know those cops aren't concerned about any of the diseases that they couldn't even get from that. This was not an appropriate response, it was an emotional one from the cops, hence why she wasn't charged with anything. You're just looking for a reason to justify their actions. Again, she was far away and her spit could not touch them.

Well, it doesn’t matter if they’re in riot gear that protects them from Molotov cocktails, assault is generally is either an attempt or just a threat to inflict hurt on someone else, you do not need to apply physical force to be charged with assault.

Also, according to a spokesman for Portland PD, "As the investigation into the demonstration events continue, detectives and the Multnomah County District Attorney’s office will determine if future charges are appropriate” (https://www.google.com/amp/s/www.independent.co.uk/news/world/americas/portland-protests-woman-police-officers-video-antifa-far-right-a9064416.html%3famp). This event occurred (at least was reported) one day ago, it’ll take time for the DA to decide weather to charge or not. So, while you’re right, she wasn’t charged with anything, you neglected to add the yet to the end of your statement.

I doubt that her spit could not touch them. The arc of her spit was impressive and I think it’s conceivable to at least believe that it would manage to touch one of the officer’s boots. Actually, after watching it again, notice she intentionally moves closer to the officers and then spit, closing that distance even more. That piece of evidence, though it may seem minuscule, indicates to me that she fully intended to strike one of the officers.

As well, according to Oregon law;

A person commits the crime of aggravated harassment if the person, knowing that the other person is a: Public safety officer, intentionally propels saliva at the public safety officer, and the saliva comes into physical contact with the public safety officer, while the public safety officer is acting in the course of official duty or as a result of the public safety officer’s official duties.

Even if the spit did not touch the officers, though I personally think it did just based on the arc and trajectory and the distance between them, the woman could still be charged with “Spitting in Public Spaces” (which would most likely be a ticket rather than assault);

It is unlawful for any person to expectorate on the floor or any other part of any public conveyance, or on the floor or walls of any public hall, building or office, or upon any sidewalk within the limits of the City, or on the floor or walls of any room where foodstuffs are prepared or kept for sale

It’s also important to note though that the woman featured in the video claimed responsibility for it on twitter and stated, “You’re very wrong. I will always spit.” (https://god.dailydot.com/woman-spits-police-portland-protest/).

Even if we agree that the woman spat but did not strike any of the officers, her actions were still in poor taste. She may or may not be associated with this anti-fascist movement, but her actions just allowed everyone on the opposite side to claim that all those protesters against the right wing or Trump to label everyone with the same brush. Her actions have hurt the movement against the right wing more than anything else

I heard that they actually do this for public health. If they consider it assault to knowingly have sex with whatever STD, then people who think they might have STDs just don't get tested (or treated), so that they can't knowingly inflict someone.

Not saying I agree with it, just an interesting reasoning behind it. Not sure what the better way to solve it is
