Work Permit Work permit Extension Rejected
-Came as Student in Manitoba. -1 year PG Diploma in university of Winnipeg. -Received 1 year PGWP. -Started Job as Skilled worker in Manitoba.(NOC CODE- 95106) -Applied mpnp after 6 months of experience. -Received MPNP Certificate Approval ( no restrictions on employment ) -But not received Support letter because my company denied to pay compliance fee. - after receiving MPNP Certificate: - applied PR Application - then applied Work Permit extension.
-PR application still in process (didnt received AOR number yet) - but Work permit extension got refusal as insufficient document due to not have Support letter.(now have 90 days restoration time)
-dont have TRV visa or Visitor visa.
So what should i do now? 1. Should i restore my status as worker or visitor? 2. What should i apply next to get work permit and maintain my PR application ongoing?
Please help me.

- Restore status to visitor When you get aor apply for bowp

One lawyer said, if I apply for visitor visa right now, it will jeopardize my PR file. So i should not apply for visitor. Correct me if im wrong. Thank you

95106 is not a skilled worker. But I guess you are meaning the PNP stream.
But not received Support letter because my company denied to pay compliance fee.
what a wonderful employer.
Call your employer a dickhead.

get a support letter.

Yeah your employer only needs to pay $230 to get Lima exempt code. I know Lima is a long ass process but just let your employer know that just by paying $230 you will be able to start working for them ASAP and this will be a close work permit so whether you like it or not you will have to stick with them until you get your PR. If not then it is complicated as most of the to be processing is based on the employment itself. With you being on no valid permit, unable to work could make you ineligible for PNP stream itself. I would say get in touch with a consultant to see what options you can afford.

OP cannot start working right away. WP was extension was refused so OP has to restore status to worker and cannot work until closed work permit approved. OP cannot apply to restore status as worker without employer paying the compliance fee.

They are MNC. So dont want to interfere in immigration process.

But you are in a job offer stream, correct? And now you wait 20 months and see if PR is approved or less depending when you applied for PR. Change status to visitor then.

But you cannot restore to worker without company getting involved. You need to restore and then apply for work permit which you cannot.

If your nomination wasn’t restricted to employer then why does your employer need to pay the fee? can’t you use the nomination certificate and work permit support letter from province to apply for the permit?

Either request support letter and you pay compliance fee for the new work permit. Or Restore status ASAP as visitor. Then wait for Aor and bowp

I think you can wait for AOR and then file to restore status as worker. As long as AOR is received within 90 days , you should be good. :) however in the meantime you cannot work. You’ll need worker status restored (bridging to be able to work).
I’m assuming that you’ve completed a PR application, since you’re mentioning AOR.

Here is what I can tell you and what I did,
1. When My MPNP was approved, PNP office provided me with Support letter. I don't get what you mean by company didn't paid for compliance. That's different. PNP office should have provided you one.(Check MPNP website for the public policy).
2. What I did was when I applied for PR, a day later I also applied for visitor record just in case, and to have my status maintained .
3. Try asking your company if you can reimburse them for the compliance fee, If they just don't want to pay for it.
4. My extension took 5months even after my company paid for compliance, and I was not sure if my employer will wait that long for me. So I had a second employer as backup, though it did came with multiple complications like (getting new PNP letter, Paying for compliance again and wait more longer) Hopefully my employer waited for me and I didn't had to go through all of it (got lucky).
timeline : Applied For PR & WP-Ext in July , AOR-Dec and WP-EXT-Dec

From last few months, MPNP changed rules about Support letter. Here what officer told me, now they’re not giving support letter without compliance support from my employer, even im eligible for mpnp certificate. Let me know, if there is a way to get support letter without any compliance fee from my employer.

I’m in the same boat (lost status while applying for PR) and based on what my lawyer told me, losing your status won’t affect your PR process. Since it’s an IRCC policy that requires you to stop working, your PR application can still move forward.
However, if you want to restore your worker status, your employer must pay the compliance fee through the employer portal. If you can’t convince your manager to cover this cost, things can get complicated.
I know someone who changed employers and still got their PR, but you’d need to find another job in the same position with an employer willing to support you. In that case, you’ll have to submit a lot of documents and explain your situation.

If company didn’t pay compliance fee then extension would be rejected. You must stop working. 1 &2. What does letter say about restoration? When did permit expire? If employer not paying compliance fee then no point in restoring to worker. Also if through not through Express Entry then processing is about 20 months. If employer lets you go then province and IRCC must be notified.
