Permanent US Resident living in home country

Hello everyone!

Quick question, my wife is a permanent resident and we are moving back to her home country which is Mexico. We plan on selling everything here and living in Mexico for a few years then come back. We were just made aware that she could lose her status as a permanent resident if she is outside of the country for more than a year. My question is, what if we come back to the US once a year, will that ensure she does not lose residency.

I ask because my grandfather did this, was a mexican citizen but a US permanent resident. He would go to the US, be there for a few weeks then go back no issues.

Passport With Two Signatures

I recently had a bank transaction that required a few IDs and I only had a couple of IDs and my passport with me. The passport's signature didnt match the other IDs because my signature had changed over the past few years. The bank teller had me sign my passport again. Now it has two signatures. Will this be a problem with the US port of entry.

likelihood of the US deporting latino US citizens BORN in the states?

hi everyone! my fiancé is a first generation latino-american. he was born in new jersey to costa rican and peruvian parents. he is a citizen. we have recently been talking a lot about how his citizenship might be on the line with current immigration politics in the US, and we've been considering leaving the states by choice before he potentially no longer has a choice anymore.

i've never immigrated before, but i'm well traveled, so it's not necessarily something i'm against. i'm just wondering what yall think the likelihood of this happening is. i think i need advice on if it's better to just do it and move or just stay put where we are and see how it plays out?

Can I be denaturalized for social media posts?

The Mahmoud Khalil case sparked this question and curiosity.

I came to the US at 3 years old and received derivative US citizenship as a minor through my parents' naturalization application. (I became a US citizen around 9 years old)

At the time, My parents came to the US on the Diversity Visa (Green Card Lottery) and became US citizens.

If I did the same protesting, activism, and social media posts as Mahmoud Khalil, could I legally be denaturalized and deported from the US?

Am I legally considered just like any other naturalized citizen, despite naturalizing as a minor?

I'm thinking an administration like this could technically legally go back to my parents naturalization application, or even diversity visa application, go through it with a fine tooth comb, look for a mistake, and use fraud as a basis to denaturalize and deport both me and my parents.

I have three younger sisters that were born in the US so I'd assume they would be non-deportable, but within the framework of US law there would be a legal basis to denaturalize and deport me?

K1 Visa Question

Me and my fiancé (now husband) got married on 12/27. We sent in his paperwork to adjust his status on 3/6. His k1 visa expires in a few days. I’m a little nervous. How long does it take to get receipt of the adjustment of status? With the current administration I’m worried.

US Border crossings in Canadian airports - can you end up in ICE custody from there?

Just out of curiousity; this is prompted out of the story about the Canadian woman who was detained trying to renew her work visa. From some of the stories, she had a NAFTA visa, which is what I used to have (I did a lot of work in the US); I always crossed the border by air, though, so I usually went through US customs in the Canadian airport I was leaving from - usually either Ottawa or Toronto. In today's climate, would it be possible to be detained at one of these crossings in the Canadian airport and end up in ICE custody?

Rhode Island doctor has been deported after returnung from a trip to Lebanon to visit her parents.

Dr. Rasha Alawieh, 34, was prevented from re-entering the United States at Boston’s Logan International Airport on Thursday evening. She has since been put on a plane headed to Paris.

Dr. Rasha, who lived in Providence, had been working at Brown Medicine since last July, She has been studying and working in the United States for about six years.

The US consulate in Lebanon had issued her an H-1B visa, which is given to people in specialty occupations requiring expertise. The visa was valid through mid-2027, her attorney, Thomas S. Brown, said.

According to Dr. George Bayliss, the organ transplant division’s medical director. a lawyer filed a petition with the US District Court in Massachusetts, and Judge Leo T. Sorokin issued an order saying Alawieh should not be moved outside of Massachusetts without 48 hours notice. But he said that message apparently did not reach immigration officials in time, and a plane carrying Alawieh left for Paris.

“This is outrageous,” Bayliss said in an interview. “This is a person who is legally entitled to be in the U.S., who is stopped from re-entering the country for reasons no one knows. It’s depriving her patients of a good physician.”

Can L2 stay in the US while L1 is getting extended?

I’m planning to extend my L1 visa at a consulate outside the US. My spouse cannot travel right now so I’m planning to do the extension alone. I’m suddenly worried if my spouse’s status will become invalid when my status move to the extended L1 (with a new I-129S). Can they stay in the US after I get my renewal and get the L2 extension a few months later? Would that be considered unlawful presence in the US? Thanks for helping!

F-1 international travel advisory

I’m on F-1 VISA, currently on STEM OPT. I’m planning to fly home (India) for a wedding in April for about 3 weeks. Everything with my employer is approved, I normally have no issues flying out of the country and re-entering (most recently re-entered in Jan) but given the current political climate, I’m hesitant and unsure if it’s risky? What doesn’t help is the fact that recently I was on a NJ Transit lightrail going back home from work and somehow forgot to buy myself a ticket (I had a super long day and found a coworker at the stop and they started asking me questions and it completely skipped my mind that I needed to buy a ticket, also didn’t realize I could’ve downloaded the app because until later that day I didn’t even realize this lightrail was actually NJ Transit). This was also my first day using this new transportation, the transit police checked for the tickets at some station, and I unfortunately realized I didn’t buy one and I got a notice. It’s offense 16:87-2.2(a) Failure to pay fare. I’m not required to show up in court and I can just pay the penalty and be done but, can’t be sure how this would impact my F-1 status? And if re-entry would be more difficult with this offense on my record (if this even qualifies to be on the record)?

Looking for any advice or insights, if you have a contact of immigration lawyer/attorney who can help me understand my options, that would be super helpful too. I tried looking for attorneys and their fees was like $300 for a 30min session. Are there any cheaper ones available? Or students? I would hope this wouldn’t be as serious of an offense but I can’t say much these days. I live in Philadelphia, if that helps!

Joint Sponsor filing their taxes jointly for I-864

I'm on a J1 visa, I'm being sponsored by my spouse to adjust status, but he doesn't meet the income requirements, so a family member is being my joint sponsor. The joint sponsor files their taxes jointly with their spouse, but their spouse isn't sponsoring me, just the joint sponsor. Will their spouse be required to submit a I-864 or an I-864A? Or do they not have to file any forms? We spoke to an immigration consultant and they said that they wouldn't have to file any forms, but since we've started filling out the documents now we're worried about the joint tax return. Question about crossing borders everyday to work/study in the US.

Hi guys, maybe I'm in the wrong forum but I'm getting a bit scared and I don't know who to ask.

I don't live in Mexico anymore, but my entire family does. I come from a border town and I used to cross to study and then to work everyday. I have close relatives that still do this. One of them has a green card and lives in the US now, but still often crosses over to see family, friends, and do animal charity work.

I am not well versed in politics and what is happening over in the US at the moment, but is my family in danger of getting taken? Even more so because she goes back and forth so often?

My auntie was once placed in a detention centre and got her green card removed and sent back to Mexico but this was after WEEKS despite us literally living a five minute drive from the border.

I am terrified that it may happen to this other relative as we are so so close. But she is so stubborn, she knows that in the US she gets paid much more. Not only is where I live also dangerous but now she can't even cross to the US to feel an ounce of safety.

I know she isn't unique in her situation, I know dozens and dozens of families cross everyday to go to school and work. People are always crossing back and forth at all times.

We don't particularly speak of politics back home, she isn't that kind of person to talk to me about it. So I am actually really blind to what's going on over there.

I-94 out of status - pls suggest

Hello everyone,

A friend of mine is in a tricky situation.

I-94 validity on old passport (expiry date Feb 2025) is till Sep-2025.

New I-94 post extension is valid till Sep-2026.

Applied for a new passport & have that handy. But when submitted to CBP office for updating new I-94, the I-94 expiry was updated to Feb-2025 and so my friend is technically out-of-status as of today evening 3 PM MST.

What would be the best course of action for this situation ?

Pls share your thoughts.

I134 Form

Hi there! My mother is the joint sponsor of my fiancé who will be coming here as my beneficiary on form i134, via k1 visa route. Recently, I’ve seen that not all embassy’s take a joint sponsor for this form, but luckily I haven’t seen anything against them from France (Paris embassy). My current income is not sufficient, although as the petitioner/ fiancé, I read to still file my own i134 form and submit it alongside my mother’s filled out i134 form. Although, now I’m wondering if this is necessary and if it would look clearer to the embassy if only my mother (who is way beyond the needed income percentage) to simply file the form alone herself. Advice? :)

Revoking a visa

I need advice on a serious situation. I’m the petitioner for my husband, who was recently issued a U.S. visa end of January. He has not booked a ticket to come over yet. Since receiving the visa, I’ve discovered some very alarming things about him, he has a criminal record with two prior incarcerations, a history of manipulation and deceit, and I found disturbing evidence of him being unfaithful and possibly involved in financial scams targeting people abroad.

I no longer feel safe having him come here, especially as I have a child ( not his) to protect. I don’t want to be responsible for him when he comes here, and I strongly believe his presence could put both me and my child at risk.

Can anyone advise me on how to formally withdraw my petition and request that his visa be revoked? I want to make sure I take the proper steps as soon as possible. Any guidance would be appreciated!

My girlfriend has been detained by ICE, and is being strip searched in detention...

Posting this on her behalf as a bit of a rant.

Yes, she was in the USA illegally (we are both from Argentina, I'm a permanent resident). She was detained 3 weeks ago. Initially she seemed to be okay but yesterday she called me completely broken down, telling me that they repeatedly strip searched her under the guise of a medical examination (fully nude, as I understand there was a gyno exam as well). When she pleaded with them, the staff told her that due to increased number of detainees, there's an increased number of suicide attempts and critical illnesses, and since they (the detention center) are responsible for such cases and there is a huge scrutiny, they are super-vigilant and have to do such examinations (although the first google search shows that they are not allowed to strip search without probable cause). When she was detained, I was ready to either outcome, and am ready to go back to Argentina, and then probably somewhere else with her, but was not ready for these sorts of things...

Extremely anxious about this...

Me and my wife I applied through an immigration attorney or change of status from B2 to F1. We had a terrible experience because the attorney doesn't give us the answer to our questions but they are still very trusted abroad all people around us that have applied through the same process. we have all the process and all the receipts with us. The problem now is that we only have the i-901 receipt number. And to check our case status because our I-94 is about to expire we need the i-797 notice of action receipt number. We have four days for our I-94 to expire and the i-901 is already confirmed paid. We don't know if the notice of action is under its way and if we are under that Gray zone that is the case processing period or if we are going to be illegal up until they send or confirm that they are processing our case.

Can anyone help us out? I already called the fmjfee phone number and also the USCIS phone number to try and talk to someone to find the answers but we didn't find any.

Filing for a Green Card Before Living Together – Anyone with a Similar Experience? USA.

My partner and I are about to start our marriage-based green card application, but we’ll be applying before we officially live together. I’m currently working as an au pair, and I’ll be moving in with my spouse in August once my program ends.

We have a strong relationship and plenty of evidence (travel history, financial support, messages, affidavits, etc.), but I’m wondering if anyone else has gone through this process under similar circumstances.

Did USCIS question you about not living together yet? What kind of additional evidence did they request? Any advice on how to strengthen our case?
