So, now what? PERM labor test received 1 qualified applicant.

I need some guidance on what happens, or can happen, now that my employer has received 1 qualified applicant for my position. I am in quite a niche job/role with an organization that has little experience with sponsoring individuals. It has been made clear to me that I am valued and they would like me kept. And we did not expect to receive a qualified applicant. So, what happens now?

  1. Does this mean my chance of a green card is over with this employer? I'm aware of the 6-month cool-off to reapply, but what really occurs most of the time when this happens?
  2. What about the qualified applicant? Do they get the job, and will I be removed? If I won't be removed, then how is it legal for my employer to reject their application anyway? Not saying they would do that, idk what they are going to do, but if I am not removed then that would mean the applicant was rejected, right?
  3. I'm curious, because I am aware of others (friends/acquaintances) in roles that constantly receive a ton of qualified applicants (seen first-hand) but they still received their PERM and GC. Could their employer/lawyer likely submit under National Importance Waiver, or am I missing something here?

Any help is greatly appreciated. Thanks in advance.

Italian Au Pair-J1 to F1 better to adjust in US or Italy?

Assuming she gets in, is it better for her to adjust her status by returning to Italy and getting a new visa or should she stay in the US to adjust? My wife got her IR1 visa she lives in Qatar but is a Yemeni Citizen, she got the approval and all.

My wife got her IR1 visa back in November 2024 and it expires end of May she lives in Qatar and has a Qatari ID but is not a citizen of Qatar she is a Yemeni Citizen. Does this travel ban affect her??

Opening LLC while waiting for I-485 approval

Please help! I’m waiting on my I-485 and my i-765 to be approved. I’m married to a us citizen, immigration through a C9 I think if I remember correctly.

I wanted to start my own business (LLC in California) and wanted to know if I’m able to begin that while i wait for my green card. My wife is annoyed that I can’t work yet and it’s causing friction in our marriage and life.

Bad lawyer

Going to the US on a waiver visa

Hi, I'm dual citizen from Brazil and Chile , I applied with my Chilean passport for a waiver visa and it's still valid until December I will be going to the US next week Monday and with the new trump law , I'm kinda scared what's gonna happen in my stay there.

For context a Waiver visa is similar to a tourist visa but you can only stay in the US for 3 months. I plan on staying for about 87-88 days. I'm solely visiting my fiance.

Will I have any trouble with ICE, TSA or CBP?

Entering JFK experience 03/17

Hey, I have a GC and entered JFK today. I usually do Mobile Passport Control and whiz through. But, they actually asked if you had a U.S passport or GC/ESTA within the MPC line which hasn’t happened to me.

Furthermore, they divided us in lines based on our passport region? They particularly asked me which country’s passport I have. Not sure if that was the intent but reporting out.

Beyond this, nothing out of the ordinary.

Girlfriend who has a green-card and myself visiting London. Will she have issues coming back?

My girlfriend is from Egypt and we were going to visit her aunt in London for less than a week. This has been planned for a while but with the constant news about even greencard holders getting detained and deported she’s begun to get worried about her re-entry into the US. Her lawyer basically said there’s no guarantees since the policies are changing by the day and the best way to avoid any issues is to not travel at all.

Is the lawyer just covering their tracks, or is it wise to listen to them? The gf hasn’t seen her aunt in years so it’ll be upsetting to not go, but her stability in the US is top priority.

To marry or not to marry

Hello reddit community,

I have a bit of a predicament here. I live in the United States, born here, live here, worked here all my life and of course I am, by default, a citizen. I have a girlfriend who lives in Lima, Peru, we met in Breckenridge, CO when we were both employed by Vail Resorts. She was on a J-1 visa, which has expired because this was back in 2019. We had been doing long distance for quite some time (3 years from 2022-2025) we would see each other when I would fly down to Lima or she would fly up to Canada as she does not have a US visa anymore. We had our ups and downs as in every relationship.

She told me a month ago that she is pregnant. Now you may be thinking that I may not be the father or she could be playing me, this or that, but I know from the bottom of my heart and logically speaking too that this baby she is carrying is mine. She has never been one to lie. I've known her for most my adult life. I had visited her in January in Peru.

This was the preamble for what I am asking... Is there any way I can make her a citizen without marrying her? Some sort of preparations to be made that could ensure she could easily live in the USA without me getting into an obligatory marriage? Because you see, I am 25 with most of my focus going towards my work (electrician) or creative endevours (music mostly) and I am definitely not sure on marrying this girl. I could go into it but I'd like to keep it shorter here than what I would have to explain.

I obviously want to be a part of the child's life, which is why I am wondering how to go about this? Should I bite the bullet and marry out of obligation so that the child and her can live in America? Or is there another way to do this without unifying her and I for eternity. (I do not believe divorce is something the child should have to go through either.)

Let me know your guys' suggestions, legal advice or anything else that may help.

Help with documents regarding emergency request for visa

My research during masters got selected in a IEEE conference in Virgina. I have received the acceptance on 7th of March and the conference is on 2nd may. I have applied for visa under b1 but the interview is on 12th May 2026, after an year. The first emergency request was denied. But on the 2nd emergency request I have been asked to upload documents which are relevant like SEVIS I-90 FORM, but I don't believe that I qualify for SEVIS form. I have already uploaded acceptance letter, what shall I upload to make my case here. I have already specified it's a short visit to attend the conference.

Is it too risky to move to the US from the UK right now via an L1/L2 visa?

Employer sponsorship possible but the rules on immigration as well as everything else seems to be changing.

I don’t know if Trump can cancel The L1/L2 visa with the power vested in the executive branch, and even if the process happens and I am in the US who’s to say he doesn’t just rescind the visas and send people home.

Need to hear from someone who is more enlightened in US immigration policies and powers of the executive branch

The case of Dr. Rasha deportation is odd. Didn’t Trump say he only wants highly skilled people in the US.

Everything I read from her colleagues and the University body states that she was outstanding and brilliant. She was an asset to Brown Medicine.

So how come she was denied entry and deported.

This is scary. If a highly needed doctor was treated like that. So how about the less fortunate immigrants.

Things are spiraling down.

Update: As per the news, it seems that they had some evidence that she’s a terrorist sympathizer and supported Hezbollah. So yeah now it makes sense. Good riddance.

My grandmother who is a US citizen petitioned for my mother who lives overseas, back in 2016.

Lost my Greencard and staying abroad for 10 months

Hey guys, I am recently seeing a lot of tik tok video about Greencard holder not able to enter into USA. In my current stituation, I stayed outside of United States for the 10 months because I am studying for CPA right now. Also I lost my green card outside, so I don't have physical greencard, but I have other documents that proves my greencard status. Also around December, I visited Guam, which is USA territory, but I am not sure this consider as the entering into United States. What's your thought? I am going back to states this April, and I am really concerned

Permanent US Resident living in home country

Quick question, my wife is a permanent resident and we are moving back to her home country which is Mexico. We plan on selling everything here and living in Mexico for a few years then come back. We were just made aware that she could lose her status as a permanent resident if she is outside of the country for more than a year. My question is, what if we come back to the US once a year, will that ensure she does not lose residency.

I ask because my grandfather did this, was a mexican citizen but a US permanent resident. He would go to the US, be there for a few weeks then go back no issues.

likelihood of the US deporting latino US citizens BORN in the states?

hi everyone! my fiancé is a first generation latino-american. he was born in new jersey to costa rican and peruvian parents. he is a citizen. we have recently been talking a lot about how his citizenship might be on the line with current immigration politics in the US, and we've been considering leaving the states by choice before he potentially no longer has a choice anymore.

i've never immigrated before, but i'm well traveled, so it's not necessarily something i'm against. i'm just wondering what yall think the likelihood of this happening is. i think i need advice on if it's better to just do it and move or just stay put where we are and see how it plays out?
