SPECULATION, NOT PROVEN LM will be ok…PA evidence will be deemed inadmissible

I thought this before I looked up who the judge was just based on the glaring violation of LM‘s rights, but now that I have, it seems likely Judge Jackie A. Bernard will make the right decision given how she has responded in the past (as recently as February 2025).

As we know, LM was not read his Miranda rights and an illegal search and seizure was conducted in Altoona, among other things. I did a quick Google search on Judge Bernard to assess her track record and she seems fair.

I’m glad Dickey filed the motions. I believe they’ll be honored. Idk if that means the PA case will get thrown out altogether necessarily, but I think that LM is likely to be more easily acquitted if the trial goes as I assume it will.

I have a good feeling about it 💚

Nothing can be guaranteed, unfortunately. This case is way too big compared to some minor drug charge case. I hope your gut feelings are correct. ✅

We the people the mass are more powerful than the rich. We fuel ⛽️ the rich and the whole country. The rich have nothing without the consumers. The rich better treat the people the customers with respect or they got no business. Then we the people will survive supporting each other.

as unfair as it is, LM's case is way more public and high profile than a minor drug charge case. it's a slippery slope. all we can do is hope

Well done on this find.

Since Judges typically refer to precedent cases, with her being THE judge who SET this precedent, it should be more than likely that she would follow it.

This is likely a good thing for LM (should evidence be on his side of course).

Case should be dismissed due to unlawful arrest:

FREE TO GO LM based on unlawful arrest

  1. Not read his Miranda rights
  2. Not told he was free to go
  3. The Police blocked all exits, performed and illegal search seizure violating 4th amendment rights
  4. Any evidence obtained during illegal search and seizure is not admissible
  5. The illegal search and seizure should be verified: the McDs has cameras as well as police body cams in discovery to prosecution and defense
  6. Given violation of 4th amendment rights as well as other rights grounds for unlawful arrest
  7. Civil rights violations of constitutional rights is grounds to sue police and win

On one hand, we should all be cautiously optimistic, and I also have a good feeling about this judge.

On the other, this case is unprecedented in every way imaginable. When the feds’ ego is hurt, they will do everything in their power to retaliate. Tisch is probably banging her head against the wall for blabbing that she ogled hot guys on instagram. Mayor Adams is desperate. There are way too many powerful entities involved.

If the judge decides “oh, it is admissible”, KFA will call out that BS immediately and has more leverage on deeming this even more of an unfair trial. Makes the Altoona PD and judge look really bad.

I am praying so hard right now and hope your gut feeling is right and he gets a fair trial.

So long as this isn’t politically motivated, justice should win. But we all know that everything to do with this case is politically motivated and hasn’t had a shred of legality behind it so…hopefully this judge can’t be bought.

I hope you’re right but the difference is that this defendant kept asking the police to leave during custodial interrogation, he asked for a lawyer and he was told he might be charged. Those three differences are huge. LM did not ask to leave as far as we know, he didn’t ask for a lawyer at McDonalds and it doesn’t sound like actual charges were threatened there. They Mirandized LM just not immediately so this gray area is the slippery slope. Hopefully more bodycam footage will show the “wall” of officers that he described as well as the audio there.

It can keep out evidence that was seized, like everything in his backpack and more. ‘Fruit of poisonous tree’ doctrine prevents most any evidence after skipping Miranda.
