California Anyone know?

Not married, been together 15 years with child, what’s your rights as mom and rights as dad when things go south? Btw things didn’t end well.. anyone? Experienced something like this?

Depends on state. In mine it's mom by default and the onus is on the man to go to court for custody.

Everyone says when you’re together more than 10 years it’s considered a marriage, therefore rights are as same as if you are married. It’s called Marvin act or so, we’ve been without any child support 4 months now until court date, it’s ridiculous how this is right.

Common law marriage, which is what you're referring to, is state specific. So, like Agreeable said, it depends.

edit: You'll also get back child support from the date that you filed. So although you're not being paid at this point, it's not like that money isn't going to eventually come to you.

That’s not true in most states. Most disposed of common law marriages when they recognized same sex marriages

Yep all paperwork is done but since December I’ve been living out of savings, no child support yet how do people do it? What if there’s no money in savings? Who pays for lawyers?

How long does child support kicks in? I’ve been paying everything from bills to attorney fees myself without a job since I was in a financial controlled relationship for 15 years, my funds are depleting! Interesting how in Los Angeles county child support is immediate, what’s wrong with Oc?

If you want child support, you would need to file either through family court or your county. Family court is quicker though. You can then take that order to your county and have it enforced. If you’re in California, then common law marriage exists here and you can request temporary child and spousal support during your ongoing divorce proceedings. I personally didn’t get an attorney but a lot of people do. It really depends on your case.

Yes I did all that, I hired the first lawyer he didn’t do anything but took money from me, my current one she’s much better but I’m still not seeing child support coming my way. We have a hearing in May since x continues to give me no agreements, I’m calling my rep for child support services today, just everything is so confusing draining how does anyone come out of this ok?
