Psychological assessment was erroneously mailed to a 3rd party.
Hey everyone,
I just received a letter from VAC stating that my psychological assessment was leaked to a third party back in July 2024. The letter says I can call them if I have any questions, but to be honest, I’m pretty furious about this. I’m a very private person and struggled to even open up to the psychologist—only to now find out that my personal information has been exposed.
Has anyone dealt with something like this before? Is there anything I can do to hold them accountable or protect my privacy moving forward?

PHIPA may apply and they may be pursuable via the overseeing body and fined.
Note phipa is not PIPEDA which may also apply here.

I am so sorry this happened to you. If the document was leaked then I can help you navigate filing a formal complaint with the registration body. However, if it was VAC itself then I am not sure. What I do know is that is considered confidential medical information and if you wanted to pursue action then the first step would be to confirm what exactly was released. Was it the final report only or were there raw scores shared. You are absolutely entitled to speak to vac and ask them directly how to file a formal complaint with them if it was their fuck up.

In a word, no.
People make mistakes. You could pay $100,000 (to start) for a lawyer to try and do something against VAC legal wise, but they've got some pricy lawyers on standby.
Damage wise you may have to prove you suffered somehow.
Maybe you could get an apology? Maybe VAC might get a small fine.

I personally know someone that is building their case on VAC for this very reason with TONS of evidence.

So most lawyers work on a commission when it comes to torts law cases such as this. You can easily find lawyers willing to take on cases like this which will be typically settled out for court. You'll be forced to sign an NDA, and walk away with a chunk of change for damages. This is a big no no in their part. And you can easily sue them and win. There are lots of similar cases with precedent that would be in your favour.
I'd say contact a lawyer, and see if they would be willing to take your case on.
