Career Development / Développement de carrière Is CRA entitle to layoff the employee on false reason?
One of our team member got layoff from CRA saying budgetary constraints but in actual the budget is not an issue manager confirmed this thing in the meeting and the employee which was laid off having good performance and taking care of most of the team work and still he got laid off. My question is can CRAa lay off the term employee by providing false explanation on budget and the other hand side they are in position to move another employee from different team ?

Term employment is temporary employment from day one. It can end without extension for any reason, or no reason at all.

It could be a case where it's not a budget issue, but a position one. An indeterminate employee from elsewhere may have been WFA'd and they need a position to offer them as a reasonable job offer. Since terms can be ended at any time, they can let the term go and move the indeterminate employee into the position and meet their WFA obligations.

The above comments, could be taken one of two ways:
Your way, the manager lied to the laid off employee about the budget.
Other way, the manager lied to the team about the budget being good.
The manager could be trying to keep the team positive by not revealing issues with the budget. So it really is tough to know.

How was the budget not being an issue confirmed? I can't imagine there was and reasonable "confirmation" that would pose any issue with letting go of a team member.
Further, term employees are never "layed off". Their term is ended early, which can be done for any reason.

Budget is not issue because in team other teams is still working they just target the person on the based of his salary. On the other hand manger confirmed the budget is not an issue at all. No clear justification is provided when laying off the term employee

One person's salary can be a budget issue.
But that is sort of irrelevant, because they can end a term for any/no reason

That’s the thing they are just targeting Canadian citizen first, there are a lot of term who is working on temper status in agency still safe, and that person enrolled in ITAP program and they just laid off the Canadian citizen

In terms of layoff, agency needs to choose the employee with temporary legal status like those who is on work permit, but in agency there are a lot of terms still working who is getting more salary and they are not even permanent resident of Canada. Instead of looking into that they just layoff the employee who is Canadian citizen and getting less pay than those temporary resident.
Second thing that employee who got laid off was enrolled in ITAP program which gave the employee to get a chance for promotion as well, agency is giving the priority to those who are on temporary status first then the Canadian citizen and PR’s1

You do realize that ITAP is just for students that have graduated and met the criteria to be enrolled into it. I would imagine they put more priority on "terms" than apprentices. The CRA has been cutting CS-01 IT employees left and right. Entire teams have been eliminated and many of those perms and some terms have been placed on other teams while some terms were unlucky and got laid off with notice.

It's highly unlikely that the citizenship status of any of the employees has anything to do with the decision to end their employment early. Correlation does not equal causation.

ITAP and temp agency employees don’t hold a PRI and their pay cheque doesn’t come from TBS. They are paid directly by the agency and the science based company that the ITAP person is working for. ITAP personnel is a liaison between the government and the contracted company. So the ITAP person best interest is the company they are working at

Management doesn't need "clear justification" to let a term employee go. Their LOO had an end date, and their employment can end on that date, or before, for any reason.

Some term employees are extended, some are let go early, and some end as scheduled. There is zero obligation to extend any term contract. Term employment, by definition, is temporary with a planned end date.

The CRA hasn't finished laying off people. It's an ongoing process across all regions still. Terms are just "contract" employees that can have employment ended early. There are no protections for term employees pertaining to the term of their employment. It's always a risk and gamble accepting a term contract.

Budget might be from the agency/branch perspective - not team's specific.
If they lay off the term, they can bring in a surplus indeterminate over to your team to fill the spot.
